Attachment B A.1 4,2 A.3 Washington State Military Department GENERAL TERMS AND CONDITIONS Department of Homeland Security (DHS/ Federal Emergency Management Agency (FEMA) Grants DEFINITIONS As used throughout this Agreement, the terms will have the same meaning as defined in 2 CFR 200 Subparl A (which is incorporated herein by reference), except as otherwise set forth below:a. "Agreement" means this Grant Agreement. b. "Departmenf' means the Washington Military Department, as a state agency, any division, section, ofiice, unit or other entity of the Department, or any of the officers or other officiils lawfully representing that Department. The Departmenl is a recipient of a federal award direcfly from ifederal awarding agency and is the pass-through entity making a subaward to a Subiecipient under this Agreement. c- "lnvestmenf'means the grant application submitted by the Subrecipient describing the project(s) for which federal funding is sought and provided under this tiis Agreementl sricn'gr;ni application is hereby incorporated into this Agreement by reference d. "Monitoring Activities" means all administrative, financiat, or other review activities that are conducted to ensure compliance with all state and federal laws, rules, regulations, authorities andpolicies. e. "Stakeholders.Preparedness Report (sPR)" The SPR is an annualthree-step self-assessment of a community's capability levels based on the capability targets identified in the THIRA,f. "Subtecipienf'when capitalized is primarily used throughout this Agreement in reference to thenon-federal entity identified on the Face Sheet of this Agreement thlt nas received a subawardflom the Department. However, the definition of "subreiipient" is the same as in 2 CFR 2OO.g3 for all other purposes. 9- "Threat and Hazard ldentification and Risk Assessment (THIRA)" The THIRA is a three-step risk assessment. The THIRA helps communities understand iheir risks and determine the level of capability they need in order to address those risks. The outputs from this process lay the foundation for determining a community's capability gaps during ine spn process. ADVANCE PAYMENTS PROHI BITED The Department shall m^ake no payments in advance or in anticipation of goods or services to be provided underthis Agreement. Subrecipient shall not invoice the Department in alvance of delivery and invoicin! of such goods or services. AMENpMENTS AND MpptFtcATtoNs The Subrecipient or the Department may request, in writing, an amendment or modification of thisAgreement. However, such amendment or modification shatl not be binding, take effect or be incorporated herein until.made in writing and signed by the authorized representatiies of the Department and the Subrecipient. No other understandings or agreements, written or oral, shal be binding on theparties. The Agreement performance period shall only be extended by (1) written notification of DHS/FEMA approval of the Award performance period, followed up with a mutualiy agreed written amendment ,or (2) written notification from the Department to the Subrecipient to provide idOitionat time for compleiion'o'f the Subrecipient's project(s). 4,4 ,t 35.
