Kittitas County Board of County Commissioners <br />August 27, 2020 <br />Page 2 of 2 <br />Decree entered on May 9, 2019 in Ecology v. Acguavella, Yakima County Superior Court No. 77- <br />2-01484-5 and assigned the following Certificate Numbers: S4 -84348-J, S4 -84347-J, S4 -84637-J, <br />and S4 -84637-J (see certificates attached hereto as Exhibits A -D and incorporated herein by <br />reference). The respective places of use of the KRD and West Side water rights, which would <br />determine the boundaries of the joint control board's operations, are identified on the map attached <br />hereto as Exhibit E and incorporated herein by reference. The KRD water right is authorized to <br />irrigate 59,122.29 acres and the West Side water right is authorized to irrigate 5,373 acres, for a <br />total of 64,495.29 irrigable acres. The undersigned petitioners propose that the formula for the <br />apportionment of the expenses of operating the joint control board among the members shall be <br />based upon the number of acres each entity is authorized to provide water to, which results in the <br />KRD paying 92% of the operating expenses and West Side paying 8% of the operating expenses. <br />Further, KRD and West Side propose that the Bylaws attached hereto as Exhibit F be adopted by <br />the Kittitas County Joint Control Board No. 1. Both KRD and West Side have water supply <br />contracts with the United States Bureau of Reclamation. Therefore, the Bylaws provide a voting <br />structure that is consistent with RCW 87.80.030. <br />The undersigned request that the Board of County Commissioners, pursuant to RCW 87.80.040, <br />examine the petition and find it to be in regular form, accept the petition for filing, and fix a time <br />and place for a public hearing on said petition. <br />The undersigned request that the Notice of Hearing be made in the form and in the manner <br />provided for in RCW 87.80.050, that the notice be published for at least three (3) consecutive <br />weeks in the official newspaper of Kittitas County, that a copy of the Notice of Hearing be posted <br />at the regular meeting places of the KRD Board of Directors and the West Side Board of Directors, <br />that a copy of the Notice of Hearing be mailed to the Department of Ecology at least thirty (30) <br />days prior to the date of the hearing. <br />The undersigned request that the Board of County Commissioners, pursuant to RCW 87.80.090, <br />determine that the creation of the joint control board is in the public interest, of benefit to the <br />irrigation entities and individual water users within those entities concerned, and will not be <br />detrimental to water right interest outside the proposed board of joint control's jurisdiction, adopt <br />a resolution approving the creation of the joint control board, designating it to be the Kittitas <br />County Joint Control Board No. 1. <br />If you or the Board have any questions or concerns, please do not hesitate to contact us. <br />Fred Schnebly, Chairman <br />Kittitas Reclamation District <br />Board of Directors <br />Very truly . urs <br />W -ell <br />Mel Dyk, President <br />West Side Irrigating Company <br />
