A.1 <br />Attachment 2 <br />Washington State Military Department <br />GENERAL TERMS AND CONDITIONS <br />Fire Management Assistance Grants. DEFINITIONS <br />As used throughout this Agreement terms will have the same meaning as defined in 2 CFR 200 <br />Subpart A (which is incorporated herein by reference), except as othenvise set forth below: <br />a. "Agreement" means this Grant Agreement. <br />b. "DEPARTMENT" means the Washington State Military DEPARTMENT, as a state agency, any <br />division, section, office, unit or other entity of the DEPARTMENT, or any of the officers or other <br />officials lawfully representing that DEPARTMENT. The DEPARTMENT is a recipient of a federal <br />award directly from a federal awarding agency and is pass{hrough entity making a subaward to <br />a subrecipient under this Agreement. <br />c. "SUBRECIPIENT" when capitalized is primarily used throughout this Agreement in reference to <br />the non-federal entity identified on the Face Sheet of this Agreement that has received a <br />subaward from the DEPARTMENT. However, the definition of "subrecipient" is the same as in <br />2 CFR 200.93 for all other purposes. <br />d. "Monitoring Activities" means all administrative, financial, or other review activities that are <br />conducted to ensure compliance with all state and federal laws, rules, regulations, authorities, <br />or policies. <br />e. "Project" shall mean the activities funded through the Fire Management Assistance Grant <br />Program as described in approved Project Worksheets and may include reimbursement of <br />approved eligible fire management assistance costs described in 44 CFR 204.42 and allowable <br />grant administration costs described in 44 CFR 204.63. <br />f. "Eligible fire management assistance costs" shall include activities performed to reduce the <br />immediate threat to life, property, and public health and safety authorized under section 403 of <br />the Stafford Act, EssentialAssistance, when directly related to the mitigation, management, and <br />control of the declared fire. Essential Assistance activities that may be eligible are described in <br />44 CFR 204.42(t) and the Washington State Fire Management Assistance Grant 2018 Applicant <br />Manual, and include, but are not limited to, police barricading and traffic control, extraordinary <br />emergency operations center expenses, evacuations and sheltering, search and rescue, arson <br />investigation teams, public information, and the limited removal of trees that pose a threat to the <br />general public. <br />g "Grant Administration Costs" shall mean administrative costs allowable under 44 CFR <br />204.63(a) and as described in the Washington State Fire Management Assistance Grant 2018 <br />Applicant Manual. <br />4.2 ADVANCE PAYM NTS PROHIBITED <br />The DEPARTMENT shall make no payments in advance or in anticipation of goods or services to be <br />provided under this Agreement and the SUBRECIPIENT shall not invoice the DEPARTMENT in <br />advance of delivery and invoicing of such goods or services, except as authorized under 2 CFR <br />200.305. <br />A.3 AMENDM ENTS AND MODIFICATIONS <br />The SUBRECIPIENT or the DEPARTMENT may request, in writing, an amendment or modification of <br />this Agreement. However, such amendment or modification shall not be binding, take effect or be <br />incorporated herein until made in writing and signed by the authorized representatives of the <br />DEPARTMENT and the SUBRECIPIENT.
