The words and phrases ljsted below, as used in this Goniract, shall each have the <br />followin g defin itions: <br />a. "DCYF" means the Department of Children, Youth, and Families <br />b. "i-ACT" me ans lndividual-Alternative Choice Training. <br />c, "Juvenile Rehabilitation" 0r "JR" means the Division under the Department of Children, Yoldh, and <br />Families. <br />2. The Contractor shall prolect, segregale, and dispose of <br />data frorn DCYF as described in Exhibil A, and as required in the Section belowentitled Socure <br />Management of Confidential lnformation. <br />4. <br />5. <br />$tatement af Work * Exhibit B. The Contraclor shall provide services and staff as described in ihe <br />Staiemeni of Work attached as Exhibit B, <br />Background Cheeks and Sexual Misconduct. <br />Background ChecklCriminat History - ln accordance wrth Chapters 388-700 WAC {JR-practices & <br />Procedures), 72.05 RCW (Children & Youth $ervices), and by the terms of this contract, Contractor <br />and each of its elnployees, subcontractor&, and/or v*lunteers wlro may or will have regular accs$$ <br />to any clienUjuvenile nrust be cleared through a JR approved crirrinal history and background <br />check. ln addition, Contractor, each cf their ernployees, subsontraetors, and/or volunteers, who <br />may or will have limited aecess to any clienVjuvenile, may be required to be cleared through a JR <br />approved crirninal history and i:ackground clreck. <br />By execulion of this contract, Contractcr affirms ihat Oontractor, each of its employees, <br />subcontractors, and/or volunteers, who may orwill have regular access have not been convisted of <br />any of lhe following: <br />(1) Any felony sex offense as d*fined in 9.944.030 RCW ($entencing Reform Act-Definitions) and <br />94.44.130 RCW (Sex Offenses); <br />(2) Any crime specifie d in Chapter 9A,44 RCW ($ex Offenses) when the victim was a juvenile in the <br />custody of ar under the jurisclictfon of JR; or <br />{3) Any violent offense as deiined in 9.94A.03Ct RCWiSentencing Reform Act-Definitions). <br />Cnntractor n":ust require that current entploy*es, volurrleers, and ccntracted service providers who <br />are au{hori:ed for regular accoss to a juverrile(s) reporl any guilty plea or conviction of any of the <br />above offenses. The reporl must be nrade to the prsffi,qn's supervisorwithin seven (7) days af <br />conviction and any psrson who harre reponed a guilty plea or conviction forone or nlore of these <br />offenses must not have regular aecess to any offende r.
