KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COAEMSSIONERS <br />STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: September 14, 2020 <br />TOPIC: Interlocal Agreement Considering Annexation and Development Within <br />the Urban Growth Area of Ellensburg <br />ACTION REQUESTED: Direct Staff Prepare Enabling Documents <br />LEAD STAFF: <br />Mark R. Cook <br />RECOMMENDATION: <br />Direct staff prepare enabling documents for Board consideration. <br />BRIEFING SUNMARY: <br />• For over a decade, the City of Ellensburg and Kittitas County have tried to <br />finalize agreement on Urban Growth Boundary administration. <br />• For the past several years, the issue of collecting impact fees within the Urban <br />Growth Area (UGA) by the County, on behalf of the City, has been the major <br />sticking point. <br />• Recently, City and County staff and elected official met discussing resolution to <br />final outstanding issues attempting to complete the interlocal agreement process. <br />BACKGROUND: <br />Building residential housing improvements in the UGA of Ellensburg can be a frustrating <br />experience for land developers. The County and the City have two separate development <br />codes and subdivision development standards. Formally adopting the City's standards in <br />the UGA makes sense to staff as eventually those land use developments are planned to <br />be within the City's corporate boundary. Collecting impact fees has been the reason for <br />no action on the proposed interlocal agreement for the past several years. Recently, City <br />and County staff and elected official met discussing resolution to final outstanding issues <br />attempting to complete the interlocal agreement process. <br />DISCUSSION: <br />Staff (both City and County) are proposing the following edits to the previous attempted <br />agreement (2016): <br />RECITALS: The third WHEREAS includes new language: "...including the <br />possibility of development impact or other fees for the review and permitting of <br />any new development within the UGA", <br />TERMS: "Transportation (policies 4.1-4.8) are added to section 2. <br />Page 1 of 5 <br />PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT <br />
