Any substitution by either <br />party must be submitted in writing. <br /> SUBRECIPIENT MILITARY DEPARTMENT <br />Name Name Gerard Urbas <br />Title Title Deputy State Coordinating Officer <br />Public Assistance <br />E-Mail E-Mail gary.urbas@mil.wa.gov <br />Phone Phone (253) 512-7402 <br /> <br />ARTICLE II - ADMINISTRATIVE REQUIREMENTS <br />The SUBRECIPIENT shall comply with all applicable state and federal laws, rules, regulations, requirements <br />and program guidance identified or referenced in this Agreement and the informational documents published <br />by FEMA applicable to the Presidential Declaration including, but not limited to, all criteria, restrictions, and <br />requirements of the “FEMA State Agreement” published by FEMA and the federal regulations commonly <br />applicable to FEMA grants, all of which are incorporated herein by reference. The Presidential Declaration and <br />the FEMA State Agreement are incorporated in this Agreement by reference. <br />The SUBRECIPIENT shall comply with the Washington State Public Assistance Applicant Manual dated March <br />22, 2020 incorporated in this Agreement as Attachment 4. The DHS Standard Terms and Conditions are <br />incorporated by reference in this Agreement in Appendix F of the Washington State Public Assistance <br />Applicant Manual dated March 22, 2020. <br />The SUBRECIPIENT acknowledges that since this Agreement involves federal award funding, the period of <br />performance described herein may begin prior to the availability of appropriated federal funds. The <br />SUBRECIPIENT agrees that it will not hold the DEPARTMENT, the State of Washington, or the United States <br />liable for any damages, claim for reimbursement, or any type of payment whatsoever for services performed <br />under this Agreement prior to distribution of appropriated federal funds, or if federal funds are not appropriated <br />or in a particular amount. <br />Federal funding is provided by FEMA and is administered by the DEPARTMENT. Under the authority of <br />Presidential Disaster Declaration number FEMA-4481-DR-WA, the DEPARTMENT is reimbursing the <br />SUBRECIPIENT for those approved eligible costs and activities necessary under the Public Assistance Grant <br />Program during the incident period beginning January 20, 2020 and continuing. Eligible costs and activities <br />will be identified in Project Worksheets approved by FEMA and a Project Worksheet Sample is incorporated as <br />Attachment 3. The DEPARTMENT is also providing Advance Payments to the SUBRECIPIENT where <br />provided by FEMA and required and allowed by law. Any interest earned on advance payments (except for <br />interest earned on advances of funds exempt under the Intergovernmental Cooperation Act (31 U.S.C. 6501 et <br />seq.) and the Indian Self-Determination Act (23 U.S.C. 450)) shall be promptly, but at least quarterly, remitted <br />to the DEPARTMENT to be paid to FEMA. The SUBRECIPIENT may keep interest amounts up to $100 per <br />year for administrative expenses. <br />A. STATE AND FEDERAL REQUIREMENTS FOR PUBLIC ASSISTANCE GRANTS: <br />The following requirements apply to all DHS/FEMA Presidential Disasters administered by the DEPARTMENT. <br /> <br />1. FUNDING <br />The DEPARTMENT will administer the Public Assistance (PA) Grant Program, provide Advance payments, <br />and reimburse approved eligible Public Assistance costs to the SUBRECIPIENT that are identified under the <br />auspices of Presidential Disaster Declaration Number FEMA-4481-DR-WA and authorized by and consistent <br />with the Stafford Act (P.L. 93-288, as amended) and applicable regulations.
