timeofperformanceand/orchangesinthework.Ifsuchdelaysand/orchangesareordered,thetimeofperformanceandcontractpriceshallbeadjustedinaccordancewiththeapplicableclausesintheContractClausesSectionofthiscontract.H.4.4TheContractoragreestoinsertthisrequirementinallsubcontractswhichinvolvetheperformanceofworkontheterrainofthesite.H.5.0SUBSTITUTIONPROCESSIONOFWORKAnyproposedkeypersonnel,minimumqualificationsforincomingorreplacementkeypersonnel,subcontractors,processes,proceduresormaterialsincludedinthequotationareherebyincorporatedintothecontract.Performanceshallbelimitedtothepersonnel,qualifications,firms,procedures,andmaterialsthatwerespecificallyidentifiedinthequotationaccepted.TheContractorshallobtaintheContractingOfficer¿swrittenconsentbeforemakinganysubstitutionsorchanges.Allsubstitutionsorreplacementsshallcomplywiththetermsandconditionsofthecontract.H.6.0ENVIRONMENTALIMPACTAllwastematerialsgeneratedbyanyworkunderthecontractperformedonaGovernmentinstallationshallatalltimesbehandled,transported,stored,anddisposedofbythecontractorandbyhissubcontractorsinaccordancewithallapplicableFederal,state,andlocallaws,ordinances,regulations,courtorders,andothertypesofrulingshavingtheeffectofthelaw,including,butnotlimitedtoExecutiveOrder12088,13October1978,FederalCompliancewithPollutionControlStandards;theFederalWaterPollutionControlAct,asamended(33U.S.C.1251ETSEQ);theCleanAirActasamended(42U.S.C.Sec7401ETSEQ);theEndangeredSpeciesAct,asamended(16U.S.C.Sec1531,ETSEQ);theToxicSubstancesControlAct,asamended(15U.S.C.Sec2601,ETSEQ);theNationalHistoricPreservationAct,asamended(16U.S.C.Sec470,ETSEQ);theSolidWasteDisposalAct,asamended(42U.S.C.6901ETSEQ);andtheArchaeologicalandHistoricPreservationAct,asamended(16U.S.C.Sec469,ETSEQ).ShouldtheUnitedStatesGovernmentbeheldliableforanyneglectorimproperactionsbythecontractororanysubcontractorregardingremovalordisposalofanyhazardouswaste,thecontractorshallreimbursetheGovernmentforallsuchliability.H.7.0HAZARDOUSMATERIALSAnymaterialsuspectedofbeinghazardousthatisencounteredduringperformanceofaprojectshallimmediatelybebroughttotheattentionoftheContractingOfficer,atwhichtimeadeterminationwillbemadeastowhetherhazardousmaterialtestingshallbeperformed.IftheContractingOfficerdirectsthecontractortoperformtests,and/orthematerialisfoundtobeofahazardousnaturerequiringadditionalprotectivemeasures,acontractmodificationmayberequired,subjecttoequitableadjustmentunderthetermsofthecontract.Thecontractorisadvisedthatfriableand/ornon-friableasbestos-containingmaterialmaybeencounteredinprojectareas.Friableasbestos-containingmaterialisanymaterialthatcontainsmorethanonepercentasbestosbyweight,andthathandpressurecancrumble,pulverizeorreducetopowderwhendry.Non-friableasbestoscontainingmaterialsarematerialsinwhichasbestosfibersareboundbyamatrixmaterial,saturation,impregnationorcoating.Non-friableasbestos-containingmaterialsdonotnormallyPage13
