KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: January 14, 2019
TOPIC: Kittitas Conservation District Floodplain Development Permit Fees
ACTION REQUESTED: Waive Certain Kittitas County Conservation District
Floodplain Development Permit Fees
LEAD STAFF:
Mark R. Cook
RECOMMENDATION:
Direct staff waive Kittitas County Conservation District (KCCD) Floodplain
Development Permit Fees for all fish barrier removal projects.
BRIEFING SUMMARY:
• Kittitas County Conservation District is working with local private land owners
removing barriers to fish passage
• Washington State Department of Fish and Wildlife is not covering these projects
under RCW 77.55.181
• Kittitas Flood Control Zone District partners with KCCD routinely on fish barrier
removal projects
• Staff supports waiving of Floodplain Development Permit fees for KCCD fish
barrier removal projects
BACKGROUND:
RCW 77.55.181 specifies the following:
4) No local government may require permits or charge fees for fish habitat enhancement
projects that meet the criteria of subsection (1) of this section and that are reviewed and
approved according to the provisions of this section.
One current KCCD project has been denied coverage by Washington State Department of
Fish and Wildlife under RCW 77.55.181. The Caribou RM 1.17 Diversion Removal
Project is the removal of a channel spanning concrete structure that was an unscreened
irrigation diversion. Previous work moved the point of diversion of water to another
location and provided a fish screen there. The current project is the final step which is
removal of the structure.
The Countys Floodplain Development ordinance does not provide discretion to the
Public Works Director waiving fees.
PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT
