Cook <br />RECOMMENDATION: <br />Direct staff waive Kittitas County Conservation District (KCCD) Floodplain <br />Development Permit Fees for all fish barrier removal projects. <br />BRIEFING SUMMARY: <br />• Kittitas County Conservation District is working with local private land owners <br />removing barriers to fish passage <br />• Washington State Department of Fish and Wildlife is not covering these projects <br />under RCW 77.55.181 <br />• Kittitas Flood Control Zone District partners with KCCD routinely on fish barrier <br />removal projects <br />• Staff supports waiving of Floodplain Development Permit fees for KCCD fish <br />barrier removal projects <br />BACKGROUND: <br />RCW 77.55.181 specifies the following: <br />4) No local government may require permits or charge fees for fish habitat enhancement <br />projects that meet the criteria of subsection (1) of this section and that are reviewed and <br />approved according to the provisions of this section. <br />One current KCCD project has been denied coverage by Washington State Department of <br />Fish and Wildlife under RCW 77.55.181. The Caribou RM 1.17 Diversion Removal <br />Project is the removal of a channel spanning concrete structure that was an unscreened <br />irrigation diversion. Previous work moved the point of diversion of water to another <br />location and provided a fish screen there.
