KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: September 24, 2018 <br />TOPIC: Weihl Road RID Legislative Process Summary <br />ACTION REQUESTED: Direct Staff Docket the "Notice of Intent to Formulate" <br />Resolution for October 16, 2018 and Schedule the <br />Required Public Hearing for November 20, 2018. <br />LEAD STAFF: <br />Mark R. Cook <br />RECOMMENDATION: <br />Direct that staff prepare a "Notice of Intent to Formulate" Resolution for Board action on <br />October 16, 2018. Additionally, direct that a public hearing be scheduled for November <br />20, 2018 receiving testimony formulating Road Improvement District 2018-01. <br />BRIEFING SUMMARY: <br />• Multiple actions are required prior to forming Road Improvement District 2018- <br />01 <br />The process begins with issuing a "Notice of Intent to Formulate" Resolution <br />Public Works prepares a notice of the formulation hearing to all benefitted <br />property owners and mails the notice at least 15 days before the date fixed for the <br />public hearing. <br />A public hearing is conducted to finalize all aspects of the RID and order its <br />formulation, continue the public hearing or decline to formulate. <br />BACKGROUND: <br />Public Works is now ready to proceed with formulating Road Improvement District <br />2018-01 Weihl Road. The boundary has been evaluated for over a year and recent <br />outreach to area residents suggest support for the district is strong. The Board's legal <br />advisor has acknowledged use of Revised Code of Washington 35.43 as the Board's <br />preferred formulation process. <br />DISCUSSION: <br />A summary of the formulation process appears below for Board consideration. <br />1. The Board issues a "Notice of Intent to Formulate" the district via resolution. <br />2. The resolution is published in at least two consecutive issues of the official <br />newspaper of the County, the first publication to be at least fifteen days before the <br />day fixed for the hearing.
