6. Kittitas County shall investigate illicit discharges in an effort to identify the source. If such <br />discharges are tracked to a specific connection to the public stormwater system, or directly <br />to surface water or groundwater, inspection and investigation of that site will be initiated in <br />compliance with the inspection procedures defined in this section. <br />C. Enforcement Authority. The Director or designee shall administer and enforce this chapter and <br />shall have the authority to adopt and implement procedures for such enforcement. <br />D. Enforcement Policy. <br />1. In the event that a stormwater facility has not been maintained and/or becomes a danger to <br />public safety or public health, the County Engineer shall notify the responsible party by <br />registered or certified mail. The notice shall specify the measures needed to comply with the <br />maintenance agreement and the maintenance plan and shall specify that the responsible <br />party has thirty days or other time frame mutually agreed to between the County Engineer <br />and the responsible party, within which such measures shall be completed. If such measures <br />are not completed, then the County Engineer shall pursue enforcement procedures <br />pursuant to Kittitas County Code Chapter 18.02. <br />2. If a responsible party fails or refuses to meet the requirements of an inspection report, <br />maintenance agreement, or maintenance plan, the County Engineer, after thirty days' <br />written notice (except that, in the event the violation constitutes an immediate danger to <br />public health or public safety, twenty-four hours' notice shall be sufficient), may correct a <br />violation of the design standards or maintenance requirements by performing the necessary <br />work to place the practice in proper working condition. The County Engineer may assess the <br />responsible party for the cost of repair work which shall be a lien on the property, or <br />prorated against the beneficial users of the property, and may be placed on the tax bill and <br />collected as ordinary taxes by Kittitas County. <br />Article Vl. Structural Design <br />12.04.06.010 Purpose. <br />The purpose of this article is to present Kittitas County criteria for the design of structural roadway <br />components for both public and private roads and streets. <br />12.04.06.020 Applicability. <br />This section applies to the design of all structural features associated with both public and private <br />roadways.
