iv. A schedule for implementing the additional BMPs including, as <br />appropriate: funding, training, purchasing, construction, monitoring, <br />and other assessment and evaluation components of implementation. <br />b. Ecology will, in writing, acknowledge receipt of the report within a <br />reasonable time and notify the Permittee when it expects to complete its <br />review of the report. Ecology will either approve the additional BMPs and <br />implementation schedule or require the Permittee to modify the report as <br />needed to meet AKART on a site-specific basis. If modifications are <br />required, Ecology will specify a reasonable time frame in which the <br />Permittee shall submit and Ecology will review the revised report. <br />C. The Permittee shall implement the additional BMPs, pursuant to the <br />schedule approved by Ecology, beginning immediately upon receipt of <br />written notification of approval. <br />d. The Permittee shall include with each subsequent annual report the results <br />of any monitoring, assessment or evaluation efforts conducted during the <br />reporting period. If, based on the information provided under this <br />subsection, Ecology determines that modification of the BMPs or <br />implementation schedule is necessary to meet AKART on a site-specific <br />basis, the Permittee shall make such modifications as Ecology directs. In <br />the event there are ongoing violations of water quality standards despite <br />the implementation of the BMP approach of this section, the Permittee <br />may be subject to compliance schedules to eliminate the violation under <br />WAC 173-201A-510(4) and WAC 173-226-180 or other enforcement <br />orders as Ecology deems appropriate during the term of this permit. <br />e. A TMDL or other enforceable water quality cleanup plan that has been <br />approved and is being implemented to address the MS4's contribution to <br />the Water Quality Standards violation supersedes and terminates the <br />S4.F.3 implementation plan. <br />f. Provided the Permittee is implementing the approved adaptive <br />management response under this section, the Permittee remains in <br />compliance with Condition S4, despite any on-going violations of Water <br />Quality Standards identified under S4.A or B above. <br />g. The adaptive management process provided under Section S.4.17 is not <br />intended to create a shield for the Permittee from any liability it may face <br />under 42 U.S.C. 9601 et seq. or RCW 70.105D. <br />G. Ecology may modify or revoke and reissue this General Permit in accordance with <br />G14 General Permit Modification and Revocation if Ecology becomes aware of <br />additional control measures, management practices or other actions beyond what is <br />required in this permit, that are necessary to: <br />1. Reduce the discharge of pollutants to the MEP; <br />2. Comply with the state AKART requirements; or <br />Eastern Washington Phase 11 Municipal Stormwater Permit —August 1, 2014 <br />Page 9 <br />
