S2. AUTHORIZED DISCHARGES <br />A. This permit authorizes the discharge of stormwater to surface waters and to ground <br />waters of the state from MS4s owned or operated by each Permittee covered under <br />this permit, in the geographic area covered pursuant to S I.A. These discharges are <br />subject to the following limitations: <br />I . Discharges to ground waters of the state through facilities regulated under the <br />Underground Injection Control (UIC) program, Chapter 173-218 WAC, are not <br />authorized under this permit. <br />2. Discharges to ground waters not subject to regulation under the federal Clean <br />Water Act are authorized in this permit only under state authorities, Chapter <br />90.48 RCW, the Water Pollution Control Act <br />B. This permit authorizes discharges of non-stormwater flows to surface waters and to <br />ground waters of the state from MS4s owned or operated by each Permittee covered <br />under this permit, in the geographic area covered pursuant to S LA, only under the <br />following conditions: <br />1. The discharge is authorized by a separate NPDES permit or State Waste <br />Discharge Permit. <br />2. The discharge is from emergency fire fighting activities. <br />3. The discharge is from another illicit or non-stormwater discharge that is <br />managed by the Permittee as provided in Special Condition S5.B.3 or S6.D.3. <br />These discharges are also subject to the limitations in S2.A.1 and S. 2.A.2, above. <br />C. This permit does not relieve entities that cause illicit discharges, including spills of oil <br />or hazardous substances, from responsibilities and liabilities under state and federal <br />laws and regulations pertaining to those discharges. <br />D. Discharges from MS4s constructed after the effective date of this permit shall receive <br />all applicable state and local permits and use authorizations, including compliance <br />with Chapter 43.21C RCW (the State Environmental Policy Act). <br />E. This permit does not authorize discharges of stormwater to waters within Indian <br />Country or to waters subject to water quality standards of Indian Tribes, including <br />portions of the Puyallup River and other waters on trust or restricted lands within the <br />1873 Survey Area of the Puyallup Tribe of Indians Reservation, except where <br />authority has been specifically delegated to Ecology by the U.S. Environmental <br />Protection Agency. The exclusion of such discharges from this permit does not waive <br />any rights the State may have with respect to the regulation of the discharges. <br />S3. RESPONSIBILITIES OF PERNHTTEES <br />A. Each Permittee covered under this Permit is responsible for compliance with the <br />terms of this permit for the regulated small MS4s which they operate. Compliance <br />with (1) or (2) below is required as applicable to each Permittee, whether the <br />Eastern Washington Phase Il Municipal Stormwater Permit—August 1, 2014 <br />Page 6 <br />
