792 -CH COURTHOUSE UNION <br />3.6 Seasonal Employee: An employee hired to fill a position either as full-time or <br />part-time seasonal employee not to exceed six (6) months duration in a twelve <br />(12) month period. A Seasonal employee who works more than one (1) month <br />in the same position shall not be covered by the terms of this agreement except <br />entry level on the salary schedule. No Seasonal employee shall work more than <br />six (6) months in a twelve (12) month period. <br />3.7 Temporary Employee: An employee hired to fill a vacancy caused by (including <br />but not limited to): extended leave situations, unanticipated excessive <br />workloads, retirements, transfers, or terminations. Temporary employee's <br />appointments shall not exceed three (3) months duration. The parties agree the <br />three (3) month time limit may be waived by mutual agreement. <br />Temporary employees will not be used to supplant or avoid filling bargaining unit <br />positions. <br />ARTICLE IV — MANAGEMENT RIGHTS <br />The Union recognizes the prerogative of the Employer to operate and manage its affairs <br />in all respects in accordance with its responsibilities, lawful powers and legal authority. <br />All matters not expressly covered by the language of this Agreement shall be <br />administered by the Employer as the Employer may determine. <br />Affairs of the Employer concerning such prerogative include but are not limited to the <br />following matters: <br />(a) The right to establish lawful work rules and procedures. <br />(b) The right to schedule work and overtime work, as well as the methods <br />and processes by which said work is to be performed in a manner most <br />advantageous to the Employer and consistent with the requirements of <br />the public interest. <br />(c) The right to hire, transfer, or promote employees as deemed necessary <br />by the Employer. <br />(d) The right to discipline, suspend, or terminate an employee. <br />(e) The right to determine the size and composition of the work force and to <br />assign employees to work locations and shifts. <br />Page 3 <br />
