792 -CH COURTHOUSE UNION <br />paid by the employee or medical insurance provider (within contractual <br />limitation). The employer will be provided semi-weekly written progress <br />reports from the employee's counselor during the entire treatment <br />program. The employee will be reinstated to the employee's former <br />position when the following conditions have been met: <br />a. The employee has successfully completed the treatment program; <br />and <br />b. The attending counselor has formally released the employee to <br />return to work; and <br />c. The employee agrees to submit to a substance abuse test. In <br />addition to any testing done as part of the rehabilitation program, <br />during the next twelve (12) months following reinstatement, the <br />employee consents to be tested up to four (4) times for the <br />presence of alcohol, drugs and/or controlled substances at any <br />time, on a random basis notwithstanding any other provisions of <br />this Agreement to the contrary. Any subsequent violation of this <br />Agreement will be grounds for immediate discharge; or <br />(2) Discharge the employee. <br />25.5 Self -Recognized Substance Abuse. Employees with a substance abuse problem <br />must immediately notify their supervisor of their condition. For evaluation <br />purposes, a substance abuse test may be appropriate. If, in the opinion of a <br />qualified drug/alcohol counselor, the employee requires rehabilitation services, <br />the employee will have an option to enroll in a rehabilitation program. Any <br />employee who complies with the above requirements prior to a violation of this <br />policy shall be immediately granted leave without pay in accordance with <br />Section 25.4 (k)(1) above. For the purposes of this section, ONLY the leave and <br />cost provisions described in Section 25.4 (k)(1) shall be applicable. <br />25.6 Employer Conducted Searches. The County reserves the right to conduct <br />searches of County property, vehicles or equipment at any time or place. Failure <br />to cooperate with these procedures, without just cause, will be grounds for <br />discharge. <br />ARTICLE XXVI — FAMILY AND MEDICAL LEAVE <br />Under the terms of The Family and Medical Leave Act of 1993 (FMLA), Title 29, Part 825 <br />of the Code of Regulations, employees may request leave without pay under the <br />following conditions: <br />Page <br />30 <br />
