Cook <br />RECOMMENDATION: <br />Direct staff submits requested United States Army Corps of Engineers <br />documents for signature: Cooperative Agreement, Certification of Lands and <br />Authorization for Entry/Attorney's Certificate/Third Party Risk Analysis. <br />BACKGROUND: <br />The United States Army Corps of Engineers is offering to repair flood damage to <br />two County levees: Schaake and Klocke. Over the past month, staff has been <br />working to determine if the Schaake Levee repair can entail setting the levee <br />back approximately 100 feet from the current location. Bureau of Reclamation <br />(BOR) cannot provide a chain of title on the Schaake property. A new easement <br />from BOR is required supporting the setback. <br />Repair of the Klocke Levee may involve Burlington Northern Sante Fe Railroad <br />(BNSF). Staff is working to finalize any actions required by BNSF impacting <br />levee repair. <br />DISCUSSION: <br />Attempts to define exact easement extend for the Schaake Levee have failed. <br />New easement documents are required to meet USACE certification <br />requirements. Timeline for survey and BOR action do not support USACE's <br />project timeline. The current location is easily certified by staff. There is a <br />consideration of added costs associated with levee setback. After much back <br />and forth, staff now believes the path forward is certifying the existing levee and <br />abandoning the setback idea at this time. The USACE is moving rapidly to <br />finalize public comment and schedule the necessary repair.
