AGREEMENT GCB 2170 <br />I-90 Exit 78 Park and Ride Lot <br />Design and Construct Park & Ride Lot Improvement <br />This Agreement for the design and construction of the I-90 Exit 78 Park and Ride Lot <br />improvement is made and entered into between the Washington: State Department of <br />Transportation, hereinafter the "STATE," and Kittitas County, Washington, a political <br />subdivision of the State of Washington, hereinafter the "COUNTY." <br />WHEREAS, the STATE and the COUNTY, in the interest of providing vanpool and carpool <br />capacity and mobility improvements in the I-90 Snoqualmie Pass East Corridor, have planned to <br />expand and improve the park and ride lot, titled " I-90 Exit 78 Park and Ride Lot," hereinafter <br />the "Project'; and <br />WHEREAS, the STATE is the fee owner of the existing park and ride lot site, located on state- <br />owned property; and <br />WHEREAS, the Project consists of those improvements to be designed and constructed by the <br />STATE as shown in Exhibit C; and <br />WHEREAS, the COUNTY is providing the funding for the Project with funds received from a <br />state Regional Mobility grant. The Regional Mobility grant funding represents the total <br />expendable funding for the Project and the total obligation of the COUNTY to fund the Project; <br />any changes to the Project will follow the process stated in Section 4. There are no funds <br />available to be expended on this Project other than the state Regional Mobility grant, <br />NOW, THEREFORE, pursuant to RCW 47.28.140, the above recitals that are incorporated <br />herein as if fully set forth below, and in consideration of the terms, conditions, and performances <br />contained herein, and the attached Exhibits A, B and C which are incorporated and made a part <br />hereof, <br />IT IS MUTUALLY AGREED AS FOLLOWS: <br />I. PLANS, SPECIFICATIONS, AND ESTIMATES (PS&E) <br />1.1 The STATE, on behalf of the COUNTY, agrees to design and construct the Project in <br />accordance with the terms of this Agreement, the current Standard Specifications for Road, <br />Bridge, and Municipal Construction, and amendments thereto (Standard Specifications) and <br />pursuant to the attached exhibits.
