Formation Criteria <br />1. Encompass only the legally assessable area, or include provisions for voluntary <br />participation by the owners of exempt property. <br />2. Encompass only the area specially benefitted by the LID project. <br />3. The total special benefit must approximately equal or exceed the total assess mentto be <br />levied. <br />Need for a Special Benefit Study <br />A special benefit analysis is recommended when: <br />1. Uncertainty exists regarding financial feasibility of the proposed project or portions <br />thereof. <br />2. Uncertainty exists pertaining to the limit of special benefit influence and, therefore, <br />location of the LID boundary_ <br />3. The proposed project includes property with irregularly shaped ownership lines or <br />significant variation in other physical characteristics such as topography, soils, drainage. <br />wetlands and amenities such as view or water frontage. <br />4. The LID boundary encompasses property with varying intensities of use or zoning <br />designations, variations in use and value created by specific locations, changing land use <br />regulations or highest and best use. <br />A special benefit analysis is not recommended when: <br />L It is acknowledged that the special benefit attributable to the project exceeds the total <br />amount of LID assessment. <br />2. Ownership lines are reasonably regular or in proportion to each other. <br />3. There is insignificant variation in intensity of use because of land use regulations, <br />topography, soils, drainage, wetlands or changes in highest and best use due to the LID <br />project. <br />4. It is not probable that the LID formation, boundary location, property assessments or <br />proportionality of individual assessments will be contested. <br />Utilize a Special Benefit Analyst to Resolve Issues <br />1. Make a p�elirninary investigation at the inception of a proposed LID project and provide <br />an opinion as to economic feasibility of the overall project and/or various components <br />thereof. <br />2. Recommend an LID boundary which encompasses all specially benefitted property and <br />provides support to withstand appeals to Superior Court. <br />Local and Road Improvement Districts Manual for Washington State Sixth Eriifion 57 <br />
