MEMORANDUM OF UNDft:RSTANOJNG <br />WASHINGTON TRAFFIC SAFETY COMMISSION <br />621 811 ' Ave SE, S11ite 409, PO Box 40944, Olympia WA 98504-0944 <br />THIS AGREEMENT is made and entered into by and between: <br />/Lrrr,rro OrPIC( <br />(Agency Name) <br />Hereinafter referred to as "CONTRACTOR" and the W ASHJNGTON TRAFFIC SAFETY <br />COMMISSION, hereinafter refetTed to as "WTSC." <br />IT IS THE PURPOSE OF THIS AGREEMENT to provide overtime funding to law enforcement <br />agencies who bnve.certified Drug Recognitic>'n Expe11s (DRE) to conduct the following activities: <br />• Respond In pca·son to rndio c;ills wh~n no other DRE is available on duly and requiring a <br />response in 'overtime ,slatus' from Ii.st of registered DR.Es. <br />• Cover shift extension 'overtime' when co~nplefing a drug evaluation or coveting a <br />request for a DRE <br />• Court testimony as a result ofperfonning drug evaluations due to these call outs and shift <br />extensions when overtime is required. (Not responsible for overtime generated from <br />cases/arrests during nonnal employment or assignment) <br />• On an overtime basis, participate in DRE sponsored emphasis patrols, allied agency <br />DRE-related requests, or other DRE programs such as teaching and training deemed <br />necessary and pre-approved by the State DRE Program Coordinator between July 1, <br />2019 through June 30, 2021. <br />IT IS, THEREFORE MUTUALLY AGREED 'THAT: <br />1. All contractor DRE.a will be maintained and availsble for callout by Washington State Patrol <br />(WSP) communications in their Individual regions. DR.Es will notify WSP <br />Communicatio:ru1 oftbelr ovnil11blllty when they s-lgn into service. Contractor DREs are <br />responsible to insure that WSP Communications hos their correct contnct information as part <br />of rhls agreement. WSP Communica1ions hns assigned a special t"Qster of DREs th at assists <br />in finding those tbat are available under these MOUs. <br />2. Contractor will provide a certified DRE on rm "overtime" basis (no to exceed 1.5 times <br />contracted salary and benefits) to perfonn drug evaluation activities as specified. No other <br />commissioned personnel will be funded. <br />3. The period of activity will begin on July I, 2019 and extend through fone 30, 2021. <br />4. Dmg evaluation perfortnance srnndnrd~ for certified and funded DREs must meet the <br />standards of the Int ernational Association of Clti~fs of Police (IACP). <br />5. DREs will maintain good standing with Drug Evaluation Classification Program; i.e. <br />papcn\i6rk, rolling logs, and resumes. (Contractor and DRE will be notified if DRE is not <br />eligible for availability and removed from WSP roster -30 day notice given.) <br />6. Disputes arising under this agreement shnU be resolved by a panel consisting of one <br />representative of the WTSC, one represen1ati ve from Contractor agency and one <br />represt.:ntative from lln: DBCP .
