Ill. <br />0MB CIRCULAR <br />ENTITY TYPE ADMINISTRATIVE I COST I AUDIT <br />REQUIREMENTS PRINCIPLES REQUIREMENTS <br />State. Local and Indian Tribal 0MB Super Circular 2 CFR 200.501 and 45 CFR 75.501 <br />Governments and Governmental <br />Hospitals <br />Non-Profit Organizations and Non- <br />Profit Hospitals <br />Colleges or Universities and Affiliated <br />Hospitals <br />For-Profit Organizations <br />Definitions: <br />"Sub-recipient''; means the legal entity to which a sub-award is made and which is accountable to the State for the <br />use of the funds provided in carrying out a portion of the State's programmatic effort under a sponsored project. The <br />term may include institutions of higher education, for-profit corporations or non-U.S. Based entities . <br />"Sub-award and Sub-grant" are used interchangeably and mean a lower tier award of financial support from a <br />prime awardee (e.g., Washington State Health Care Authority) to a Sub-recipient for the performance of a substantive <br />portion of the program. These requirements do not apply to the procurement of goods and services for the benefit of <br />the Washington State Health Care Authority, <br />IV. STANDARD FEDERAL CERTIFICATIONS AND ASSURANCES -Following <br />are the Assurances, Certifications, and Special Conditions that apply to all federally funded (in <br />whole or in part) agreements administered by the Washington State Health Care Authority. <br />CERTIFICATIONS <br />1. CERTIFICATION REGARDING <br />DEBARMENT AND SUSPENSION <br />The undersigned (authorized official signing <br />for the contracting organization) certifies to <br />the best of his or her knowledge and belief, <br />that the contractor, defined as the primary <br />participant in accordance with 45 CFR Part <br />76, and its principals : <br />a) are not presently debarred, suspended, <br />proposed for debarment, declared <br />ineligible, or voluntarily excluded from <br />covered transactions by any Federal <br />Department or agency; <br />b) have not within a 3-year period preceding <br />this contract been convicted of or had a <br />civil judgment rendered against them for <br />commission of fraud or a criminal offense <br />in connection with obtaining, attempting <br />to obtain, or performing a public (Federal, <br />State, or local) transaction or contract <br />under a public transaction; violation of <br />Federal or State antitrust statutes or <br />commission of embezzlement, theft, <br />forgery, bribery, falsification or <br />destruction of records, making false <br />statements, or receiving stolen property; <br />c) are not presently indicted or otherwise <br />criminally or civilly charged by a <br />Washington State <br />Health Care Authority Page 45 of90 HCA Contract No. K3924
