2019 Docket Enabling Ordinance December 3, 2019 <br />Page 12 <br /> <br />I. The Planning Commission recommended approval to the Board of County Commissioners <br />with a vote of 4-0. <br />II. No public testimony for this proposal was received. <br />III. This non-project rezone and land use change is consistent with KCC 17.98 and KCC <br />15B.03. <br />IV. The change will not go into effect until TDR’s are provided pursuant to KCC 17.13.080.2(a) <br />and (b). <br />V. The change meets the Growth Management Act and the objectives of the Comprehensive <br />Plan. <br /> <br />19-13 Citizen-Initiated Proposal: <br />Amendments to Title 13 and 17 regarding development in Urban Growth Areas, Exhibit M. <br /> <br />This amendment was proposed by a private citizen and has been assigned file number CP-19-00004. <br />The request is a text amendment from Steve Willard to allow for infill in the UGAs and to allow <br />development with UGAs. The applicant originally proposed five (5) text amendments but later <br />revised and/or withdrew his requests as follows: <br /> Text Amendment 1 <br />KCC 13.08.090 Recording Plat, Conditions Precedent (Title 13.08 Private Sewage Disposal <br />System in Plats) <br /> <br />Text Amendment 2 - WITHDRAWN by applicant on 10/25/2019 <br />KCC 17.11.040 Infrastructure (Title 17.11 Urban Growth Area) <br /> <br />Text Amendment 3 <br />KCC 17.11.050 Minimum Density (Title 17.11 Urban Growth Area) <br /> <br />Text Amendment 4 <br />KCC 17.22.030 Lot – Size Requirement (Title 17.22 UR – Urban Residential Zone) <br /> <br />Text Amendment 5 - WITHDRAWN by applicant on 10/25/2019 <br />KCC 17.58.050 Uses, Development Requirements, and Restrictions (Title 17.58 Airport <br />Zone) <br /> <br />The Planning Commission recommended to retain text amendment 1 as submitted by applicant on <br />October 25, 2019 with striking the reference to the Ellensburg UGA, retain text amendment 3 as <br />submitted by applicant on October 28, 2019 with striking the reference to the Ellensburg UGA, and <br />retain text amendment 4 as submitted by applicant on October 28, 2019 with striking the reference to <br />the Ellensburg UGA. <br /> <br />The Board of County Commissioners held a public hearing on November 12, 2019 and approved the <br />request as presented by staff based on the Planning Commission recommendation and directed <br />staff to reword the new text for grammatical consistency by a 3-0 vote, finding that: <br />I. The Planning Commission recommended approval to the Board of County Commissioners <br />with a vote of 4-0. <br />II. No public testimony for this proposal was received. <br />III. The change meets the Growth Management Act and the objectives of the Comprehensive <br />Plan. <br /> <br />
