<br />5-1 <br />CHAPTER 5. <br />CAPABILITY ASSESSMENT <br />This chapter provides an overview of the current capabilities of Kittitas County in addressing hazard <br />mitigation. These include federal, state, and local laws and ordinances, government plans and programs, <br />and nongovernmental organizations and resources. <br />5.1 LAWS AND ORDINANCES <br />Existing laws, ordinances and plans at the federal, state and local level can support or impact hazard <br />mitigation initiatives identified in this plan. Hazard mitigation plans are required by 44 CFR to include a <br />review and incorporation, if appropriate, of existing plans, studies, reports, and technical information as <br />part of the planning process (Section 201.6.b(3)). Pertinent federal and state laws are described below. Each <br />planning partner has individually reviewed existing local plans, studies, reports, and technical information <br />in its jurisdictional annex, presented in Volume 2. <br />5.1.1 Federal <br />Disaster Mitigation Act <br />The DMA is the current federal legislation addressing hazard mitigation planning. It emphasizes planning <br />for disasters before they occur. It specifically addresses planning at the local level, requiring plans to be in <br />place before Hazard Mitigation Grant Program funds are availabl e to communities. This plan is designed <br />to meet the requirements of DMA, improving the planning partners’ eligibility for future hazard mitigation <br />funds. DMA 2000 amended the Robert T. Stafford Disaster Relief and Emergency Assistance Act by <br />repealing the previous mitigation planning provisions and replacing them with a new set of requirements <br />that emphasize the need for State, local, and Indian Tribal entities to closely coordinate mitigation planning <br />and implementation efforts. Table 5-1 details the three grant programs under the Hazard Mitigation <br />Assistance (HMA) program. <br />Table 5-1.
