CF-P24: No preliminary development permit shall be issued by the County unless the applicant complies <br />with one of the following policies: <br />• The applicant may voluntarily request a determination of the capacity of public facilities as part of the <br />review and approval of the preliminary development permit. <br />• The applicant may elect to request approval of a preliminary development permit without a <br />determination of capacity of public facilities provided that any such order is issued subject to <br />requirements in the applicable land development regulation or to specific conditions contained in the <br />preliminary development permit that: <br />» Final development permits for the subject property are subject to a determination of capacity of <br />public facilities, as required by GPOS.21. <br />» No rights to obtain final development permits, nor any other rights to develop the subject property <br />have been granted or implied by the County's approval of the preliminary development permit <br />without determining the capacity of public facilities. <br />CF-P25: Development permits shall be subject to the following requirements: <br />• The determination that facility capacity is available shall apply only to specific uses, densities and <br />intensities based on information provided by the applicant and included in the development permit. <br />• The determination that facility capacity is available shall be valid for the same period of time as the <br />underlying development permit, including any extensions of the underlying development permit. <br />• The standards for levels of service of public facilities shall be applied to the issuance of development <br />permits on the following geographical basis: Roads: applicable roads and areas impacted by the <br />proposed development. <br />CF-P26: The County shall develop, adopt and use implementation programs which integrate its land use <br />planning and decisions with its planning and decisions for public facility capital improvements. <br />CF-P27: The County and each municipality in the County may establish a countywide process for siting <br />essential public facilities of region-wide significance. This process may include: <br />• An inventory of needed facilities. <br />• A method of fair share allocation of facilities. <br />• Economic and other incentives to jurisdictions receiving such facilities. <br />• A method of determining which jurisdiction is responsible for each facility. <br />• A public involvement strategy. <br />• Assurance that the environmental and public health and safety are protected. <br />CF-P28: The County may develop and adopt regulations that ensure that the facility siting is consistent with <br />the adopted County comprehensive plan, including: <br />• The future land use map. <br />• The Capital Facilities Plan Element and budget. <br />• The Utilities Element. <br />• The Transportation Element. <br />• The Housing Element. <br />Page 70
