Filed for Record 04/16/2009 04 :48 :53 PM -Kittitas County, WA Auditor -200904160090 Page 17 of 118 <br />"MPR Project Development Permit'' shall mean Ordinance No. 2000-I 5 (EXHIBIT F). <br />approving Trendwest's MPR Application together with the MountainStar MPR Conditions <br />associated therewith. as described in Recital 1(10) of this Agreement. <br />"Open Space" means any land that is retained in a substantially natural condition <br />(including road right-of-ways retained in a substantially natural condition) or that is improved for <br />outdoor recreational uses, such as golf courses, cross country skiing. hiking or nature trails, <br />equestrian and bicycle paths, or land that is specifically required to be preserved pursuant to (i) <br />the MountainStar Resort Conceptual Master Plan. or the MPR Project Development Permit and <br />MountainStar MPR Conditions; (ii) pennanenl conservation easement; (iii) deed covenant, <br />condition or restriction running with the land on residential lots; or (iv) a similar method. Open <br />Space includes water bodies such as ponds, rivers and streams, lands protected as important <br />natural features. such as vegetation cover or slopes, and lands used as buffers. Open space also <br />includes land that is managed by Trcndwest for recreational. habitat enhancement and forestry <br />purposes in accordance with a land stewardship plan developed by Trendwest and approved by <br />the BOCC; provided, however, that such plan may be limited by the terms of conservation <br />easements or other appropriate instruments conveyed by Trendwest to third parties to further <br />restrict the use of specified open space areas. such as the Cle Elum River Corridor (Planning <br />Area 11 in the MountainStar EIS). Open Space does not include: (i) those portions of residential <br />lots not specifically protected by a pennanent conservation easement, deed covenant, condition <br />or restriction, or similar method; (ii) streets; and (iii) parki~g areas. <br />"Original MPR Policies" shall mean those Comprehensive Plan policies relating to the <br />development of Master Planned Resorts adopted by the BOCC through Ordinance No. 96-20, as <br />set forth in Recital 1(1) of this Agreement. <br />Suncadia Master Planned R,:,.,ort Develorment Agreement (Amended and Resuit.ed 12·02-2008) Page 16
