Filed for Record 04/16/2009 04:48:53 PM - Kittitas County, WA Auditor - 200904160090 Page 14 of 118 <br />structures and facilities, such as clubhouses, practice facilities, and maintenance facilities), tennis <br />courts, swimming pools, sports complexes, cross country skiing, hiking and nature trails. bicycle <br />paths, equestrian facilities_ skating arenas, bowling alleys and theaters. <br />"Development Agreement Statute" shall mean RCW 36.70B.170 through .210, as set <br />forth in Recital A of this Agreement. <br />"Development Standards" shall mean the standards controlling development of the <br />MountainStar Master Planned Resort, as more specifically described in Section 4.1(d) of this <br />Agreement. <br />"Director of Community Development Services" or "Director" shall mean Planning <br />Director. <br />"Division" means a smaller area within a Phase, may include one or more parcels or <br />subdivisions of land. and can also be described as a "subphase.- <br />"Eastern Board" shall mean the Eastern Washington Growth Management Hearings <br />Board, as set forth in Recital 1(1) of this Agreement. <br />"Effective Date" shall have that meaning set forth in Section LI of this Agreement. <br />"General Site Plan" shall have that meaning set forth in Section 5.1(a) of this Agreement. <br />"GMA" shall mean the Washington State Growth Management Act, Ch. 36.70A RCW. <br />as set forth in Recital I(1) of this Agreement. <br />"Infrastructure" shall mean all Utilities, as defined in this Agreement, and roads and <br />bridges. <br />"JELD-WEN" shall mean JELD-WEN, iNC., an Oregon corporation registered to <br />conduct business in the state of Washington, as set forth in Recital B to this Agreement. <br />Suneadia Master Planned Resort Development Agreement (Amended and Rcstatcd 12-02-2008) Page 13 <br />
