A16 EQUAL EMPLOYEMENT OPPORTUNITY (EEO) <br />A16.1 SOURCE <br />2 CFR 200, Appendix II(Q <br />41 CFR § 60-1.4 <br />41 CFR § 60-4.3 <br />Executive Order 11246 <br />A16.2 APPLICABILITY <br />The purpose of this provision is to provide equal opportunity for all persons, without regard to race, <br />color, religion, sex, or national origin who are employed or seeking employment with contractors <br />performing under a federally assisted construction contract. There are two provisions — a construction <br />clause and a specification clause. <br />The equal opportunity contract clause must be included in any contract or subcontract when the <br />amount exceeds $10,000. Once the equal opportunity clause is determined to be applicable, the <br />contract or subcontract must include the clause for the remainder of the year, regardless of the amount <br />or the contract. <br />Contract Types — <br />Construction —The sponsor must incorporate contract and specification language in all <br />construction contracts and subcontracts as required above. <br />Equipment—The sponsor must incorporate contract and specification language into all <br />equipment contracts as required above that involves installation of equipment onsite (e.g. <br />electrical vault equipment). This provision does not apply to equipment acquisition projects <br />where the manufacture of the equipment takes place offsite at the vendor plant (e.g. ARFF and <br />SRE vehicles). <br />Professional Services —The sponsor must include contract and specification language into all <br />professional service agreements as required above. <br />Property–The sponsor must include contract and specification language into all land acquisition <br />projects that include work that qualifies as construction work as defined by 41 CFR part 60 as <br />required above. An example is installation of boundary fencing. <br />Use of Provision — MANDATORY TEXT. 41 CFR § 60-1.4 provides the mandatory contract language. 41 <br />CFR § 60-4.3 provides the mandatory specification language.
