A8 CONTRACT WORKHOURS AND SAFETY STANDARDS ACT <br />REQUIREMENTS <br />A8.1 SOURCE <br />2 CFR § 200, Appendix II(E) <br />A8.2 APPLICABILITY <br />Contract Workhours and Safety Standards Act Requirements (CWHSSA) requires contractors and <br />subcontractors on covered contracts to pay laborers and mechanics employed in the performance of the <br />contracts one and one-half times their basic rate of pay for all hours worked over 40 in a workweek. <br />CWHSSA prohibits unsanitary, hazardous, or dangerous working conditions on federally assisted <br />projects. The Wage and Hour Division (WHD) within the U.S. Department of Labor (DOL) enforces the <br />compensation requirements of this Act, while DOL's Occupational Safety and Health Administration <br />(OSHA) enforces the safety and health requirements <br />Contract Types — <br />Construction —This provision applies to all contracts and lower tier contracts that exceed <br />$100,000, and employ laborers, mechanics, watchmen, and guards. <br />Equipment—This provision applies to any equipment project exceeding $100,000 that involves <br />installation of equipment onsite (e.g. electrical vault equipment). This provision does not apply <br />to equipment acquisition projects where the manufacture of the equipment takes place offsite <br />at the vendor plant (e.g. ARFF and SRE vehicles). <br />Professional Services —This provision applies to professional service agreements that exceed <br />$100,000 and employs laborers, mechanics, watchmen, and guards. This includes members of <br />survey crews and exploratory drilling operations. <br />Property— While most land transactions do not involve employment of laborers, mechanics, <br />watchmen, and guards, under certain circumstances, a property acquisition project could <br />require such employment. Examples include the installation of property fencing or testing for <br />environmental contamination <br />Use of Provision — MANDATORY TEXT. Sponsors must incorporate this text without modification. <br />A8.3 CONTRACT CLAUSE <br />CONTRACT WORKHOURS AND SAFETY STANDARDS ACT REQUIREMENTS <br />1.
