(II) The CRABoard hereby agrees to re imb urse the county from RATA fund s a ll ocated , and not otherwise, for it s reimburs ab le costs not to exceed the amo unt above s pecified. (12) The CRABoard w ill reimburse counties on th e bas is of mon thl y progress payment vo uchers rece ived a nd approved on ind iv idu al projects in th e o rd e r in which they a re rece iv ed in the CRABoard office, a nd s ubject to th e availability of RATA funds apportioned to the region. S uch obligation to reimbu rse RATA fund s extends o nl y to proj ect cos ts incurred after the da te of proje ct approval by the CRABoard. (13) Either the CRA Board o r the County ma y request c ha nges to th e provision s conta ined in thi s agreement. Such changes sha ll be mutually agree d up o n and in corporated by written amend m en t to thi s agr eement. No variation or alteration of the term s of thi s agreement sha ll be val id unles s mad e in w riting and s ign ed by authorized represe ntat iv e s of th e CRA Board or th e County hereto . (14) Du r ing th e te r m ofthis agreement and for a period not less th an s ix (6) years from the date of final payment by the CRABoard, the record s and accounts pertaining to thi s agreemen t are to be kept avai labl e for inspection a nd a udit and copies of all records, acco unts, documents, o r other d ata pe rt a inin g to th e agreement w i 11 be furnished upon req ues t. If a ny liti ga tion , c laim , or a udit is commenced, the records and accounts along with suppo nin g documentation shall be retained until sa id li tigat ion , c laim , or a udit finding ha s been reso lved even though s uc h liti gat ion, claim , or audit continues past th e s ix yea r retention period . IN CONS IDERATI ON of the allocation by th e CRABoard RATA funds to th e project in the amount set out a bove, the County hereby agrees that as condition precede nt to payment of any RATA fund s allocated at a ny time to th e a bove referenc ed project, it accepts and will comp ly with the term s of this agreement, including th e te nn s and conditi on s set fOlth in C hapter 49, La w s of 1983 , I st Ex. Sess. (c hapter 36.79 RCW); the applic a bl e rules of Title 136 WA C and a ll representatiu ns made to the CRABoard upon whi ch th e fund allocation was based ; all of which are familiar to and within th e know ledge of th e co un ty a nd a re incorporated herein and made a part of t hi s agreement , although not attached. Thi s agree ment supersedes all pri or agree ments issued using th e project number li sted above and s ha ll be valid and binding only if it is s ig ned a nd retume d to th e CRABoard office wi thin 45 days of its mailing by the CRABoard.
