No court <br />costs will be assessed against any Kittitas County officer or authority if the <br />dog is not found to be pote nfiaTly dangerous . <br />(x) If th e court finds sufficient evidence to support the declaration . it shaJI impose <br />court costs on the appellant and may impose addi ti on al restrictions on the <br />animal. <br />(el The owner of any animal found to be a potentially dangerous dog under this Chapter shall be <br />assessed all service costs under this SecUon . <br />(d) The owner of any animal found to be a potentially dangerous dog under this <br />Chapter must keep animal conlro l authority notified of the location of the animal at <br />all times and must have the consent of the animal control authority to move the dog <br />in or out of Kittitas County . <br />(e) Fo llowing service of a declaration of potentially dangerous dog, and pending aopeals under this <br />Section or to any other court with jurisdiction, the animal control authority may . if circumstances require, impound the <br />animal at the owner's expense , pursuan t to the provisions of this Chapter. until a court orders either its redem ption or <br />destruction. <br />m Any owner found to be in possession of a potentially dangerous dog shall control <br />the animal as under KCC 6.01 .190 . <br />{oj The owner of a dog found to be potentiallv dangerous shall obtain a li cense . The license fee for each potentially <br />dangerous dog licensed under this Chapter shall be set by the legislative body of the County on an interim basis as <br />part of the Kittitas County Sheriff Office 's fee schedu le. <br />3. la} nle department or its authorized agent may find and declare a dog dangerous if it has probable <br />cause to believe that the animal falls under the definition stated in KCC 6.01.020(10). The dec laration of dangerous <br />dog shall be in writing and shall be served on the owner in one of the following methods: <br />(i) Certified mail to the owner or keeper's last known address if known; or <br />(ii) Pe rsonally: or <br />(iii) If the owner cannot be located by one of the first two methods . by publication <br />in a newspa per of general circulation. <br />(b) The declaration of a dangerous dog shall state : <br />m A description of the dogj <br />iii) The name and address of the owner or keeper of the dog if known ; <br />(iii) The whereabouts of the dog if it is not in the custody of the owner ; <br />(iv) The facts upon which the declaration of a da ngerous do g is based ; <br />(v) The restrictions placed on the animal as a result of the declaration of dangerous dog ; <br />(vi) The penalties for violation of the restrictions. including the DOssibility of destruction of the <br />animal. and imprisonment or fining of the owner; <br />(vlj) The owner has fifteen (15) days to object to the declaration : <br />(viiiHhe availability of a hearing if the owner of the dog objects to the declaration <br />and submits a request for a nearing to the district court ; <br />(ix) If the court finds there is insufficient evidence to suoport tne declaration , it <br />shall be rescinded and the restrictions imposed thereby annulled. No court <br />costs will be assessed against any Kittitas County officer or authority if the <br />dog is not found to be dangerous. <br />(xl If the court finds sufficient evidence to support the declaration, it shall impose <br />court cosls on the aopellant and may Impose additional restrictions On the animal. <br />(c) The owner of any animal found to be a dangerous. dog under this Section shall be <br />assessed all service costs under this Subsection. <br />(d) The owner of any animal found to be a danaerous dog under this Section must keep <br />animal control authority notified of the location of the animal at all times and must <br />have the consent of the ani ma! controJ authority to move the dog in or out of <br />2017 Docket Enabling Ordinance <br />Ord. # 2018-001 <br />January 2,2018 <br />Page 79
