(c) Has disp laye d aggressIve behavior, attacked . or endangered the safety of humans or domestic animals after such dog has been detennlned by an appropriate au thority, including but not limited to any officer of the county dog control department, to be potentially dangerous , and the owner of such dog has been noti fied, either orally or in writing that the dog has been determined to be pote ntially danderous . 11 . "Departmen t" mea ns the Kittitas County Sheriff's Offi ce 12 . "livestock " means cattle, sheep. horses , llamas, buffalo , deer, elk, rabbits, mules . donkeys . goats , swine , fowl. poultry , and any fur-bearing an ima l bred and maintained commercially or otherwise within pens , fences , cag es or hutches . 13 . "Ml c roch i p~ means a dev ice Implanted for identification purposes. 14. "N ui sance ~ means any unl awfu l acl. or failu re to perfo rm a duly . whlcl1 ac t or fail ure -eithe r annoys , Injures , or endangers the comfort, repose , health or safety of other persons , or Interferes with other persons' lise of property. 15 . "Owner" means any person or legal entity who knowingly harbors, keeps , possesses or maintains an animal , or whO encourages an anima l to remain about their property for a period of 72 hours or more , or who is the person named on Ihe license/reg istrat ion record of any anima l as the owne r. The parent or guardi an of an owner under eighteen years of age sha ll be deemed the owner for the purposes of this chapter . 16 . "Permit" means and incl ud es huma n condu ct that is Intentio nal . deliberate . careless , inadvertent or neg li gent in relation 10 any animal owned by the person . 17 . "Person" means any indiv idual or natural person at least 18 years of age , assoc iation . finn . partnersh ip. corporation or other legal . entity . 18. "Physical ln lury" means impairment of physical condition or substantial pain which is directly cauSBd by a dog 's be havior. and incl ud es scratches. scrapes , cuts . punctu res or other evid ence of phystcal lniu rv . but not to include dog bite or bites , 19 . "Potentially Dangerous Dog" means : (a) Any dog that without provocation: (i) Bites or otherwise injures a human person or a do mestic animal on either public or private property; or (b) Any dog which reasonably should be known by its owner to be disposed: (i) To attack or chase or approach persons in a menacing fashion or apparent attitude of agg ression or attack without provocation; or (ii) To cause injury , or otherwise threaten the safety of humans or domestic animals . (c) Any dog at large in a pack of three or more. 20 . "Premises ,r means th e area of land to wh ich a person has lega l or equitab le ri ghts of possession, use and control. 21 . "Quarantine area" means any area defined by ) but not lim ited 10 , a ve terinarian , physician. public health official . or Animal Control Officer. where . for a specified period of time . a dog is to be kept separated from othe r animals or people . 22 . "Secure enc lo sure " means secure confinement of a dangerous dog or a potentially dangerous dog on its owner's premises, either indoors or in a securely enclosed and locked pen or structure , suitable to prevent the entry of young children and designed to prevent the animal from escaping . Such pen or structure sha lf have secu re sides . a secure top and a secure bottom, and shall also prov ide protection from the elements for the dog . . 23 . "Seneus physical i Qjurv~ meaJ1S any physical injury which creates a substantial risk of death or causes pe rmanen t loss or protrac ted impa irment of any bodily organ or func ti on . or substantial disfigurement. 24 .
