Agreement Number: K2474 <br />Page 3 of 8 <br /> <br />all invoices submitted which document satisfactory performance of the Agreement. <br />Before and after photos of the project are encouraged. The Department will not pay <br />invoices not accompanied by such documentation. All documentation for final <br />payment must be received no later than July 31, 2019 or the Contractor will not <br />be paid for the project discussed herein. Payment will not be provided for any <br />work conducted or purchases made after June 30, 2019. <br /> <br />Instead of one invoice, the Contractor may submit invoices, documentation of <br />satisfactory performance, and proper receipts of expenses on a more frequent basis <br />provided it is not more than once a month. <br /> <br />6. DISALLOWED COSTS <br /> <br />The Contractor is responsible for any audit exceptions or disallowed costs incurred by <br />its own organization or that of its Subcontractors. <br /> <br />7. EVALUATION, REPORTING, AND MONITORING <br /> <br /> <br />a) The Contractor shall submit documentation to the Department when the project is <br />completed and shall confirm that the terms and conditions of this Agreement have <br />been met, including a report of compliance with the Community Benefit provisions <br />of Section 3. <br /> <br />b) The Contractor shall cooperate with and freely participate in any monitoring or <br />evaluation activities conducted by the Department that are pertinent to the intent of <br />this Agreement, including an on-site inspection of the capital improvement project <br />after its completion and prior to June 30, 2019. <br /> <br />d) The Department or the State Auditor and any of their representatives shall have <br />full access to and the right to examine during normal business hours and as often <br />as the Department or the State Auditor may deem necessary, all the Contractor’s <br />records with respect to the matters covered in this Agreement. Such <br />representatives shall be permitted to audit, examine, and make excerpts or <br />transcripts from such records and to make audits of all contracts, invoices, <br />materials, payrolls, and records of matters covered by this Agreement. The <br />contractors shall retain records for a period of six years following completion of the <br />project. <br /> <br />8. NONDISCRIMINATION PROVISION <br /> <br />a) During the performance of this Agreement, the Contractor shall abide by all <br />applicable federal and state nondiscrimination laws and regulations, including, but <br />not limited to chapter 49.60 RCW , Washington’s law against discrimination, and 42 <br />U.S.C. 12101 et. seq., the Americans with Disabilities Act (ADA). <br /> <br />b) In the event of the Contractor’s noncompliance or refusal to comply with any <br />nondiscrimination law, regulation, or policy, this Agreement may be rescinded, <br />canceled, or terminated in whole or in part, and the Contractor may be declared <br />ineligible under this Agreement.
