Palomino Fields Development Agreement <br />Narrative <br />IF1EC E IVB <br />AN 22 � <br />KITTI TAS COUNTY <br />CDS <br />On November 18, 2008 the Kittitas Board of County Commissioners approved the <br />Palomino Fields Plat (P-07-31/Res. 2008-160) vesting to the Suburban Zoning Code. <br />The Palomino Fields Plat contains numerous required mitigations, as part of the <br />mitigated threshold determination. Furthermore the proposal for the Palomino <br />Fields Plat only discusses the phasing of the proposed water system. Kittitas County <br />Community Development Services Department has determined that the phasing of <br />the actual development was vague. <br />With the aforementioned, it was recommended by Kittitas County Community <br />Development Services Department that we should pursue the Development <br />Agreement process in order to further address phasing of the actual development. <br />On October 6th, 2015 we submitted a Development Agreement Application and <br />supportive materials. At the same time we have had numerous meetings since then <br />finalizing our documents. Pursuant to Kittitas County Code (KCC) 15A.11 and <br />consistent with RCW 36.70B.170 through 210, an applicant may request a <br />development agreement addressing the requirements in KCC 15A.11.020(e). <br />Specifically KCC 15A.11.020(5) "development standards" including, but not limited <br />to a. Project elements such as permitted uses, residential densities, and nonresidential <br />densities and intensities or building size; b. Mitigation measures, development <br />conditions, and other requirements sunder Chapter 43.21RCW; c. Design standards <br />such as maximum heights, setbacks, drainage and water quality requirement, <br />landscaping, and other development features; d. Road and sidewalks standards; e. <br />Affordable housing; f. Water sewer, storm drainage and other infrastructure <br />requirements; g. Parks and open space preservation; h. Phasing; i. Development review <br />processes, procedures and standards for implementing decisions, including methods of <br />reimbursement to the county for review processes; j. A build -out or vesting period for <br />applicable development standards; k. Process for amending the development <br />agreement; and i. Any other appropriate development requirement or procedure. <br />Throughout numerous reviews with staff KCC 15A.11.020(5) a, b, c, d, e, f, and g <br />have already been addressed within the actual preliminary approved plat (Res. <br />2008-160). The Development Agreement application proposal specifically <br />addresses phasing (KCC 15A.11.020(5) h), along with clarifying the development <br />standards (KCC 15A.11.020(5) i, j, and k) within this Development Agreement <br />application. This Development Agreement proposal is not proposing to add, <br />remove or change the existing approved preliminary plat, but is requesting that <br />additional phasing be considered. Furthermore since there is no major significant <br />change pursuant to KCC 15.04.180 and WAC 197-11-600 thru 635 we are <br />requesting that the existing SEPA checklist, Notice of Action/MDNS and all other <br />existing environmental documentation under Resolution 2008-160 be adopted <br />satisfying the SEPA requirement for Development Agreements. <br />
