TE <br />G <br />July 16, 2009 <br />Andy Kottkamp <br />Hearing Examiner <br />PO Box 1667 <br />435 Orondo <br />Wenatchee, WA 98807 <br />JUL 1 u" 2009 <br />Subject: Marion Cluster Plat (P-06-06) Response to July 9`", 2009 <br />Hearing Testimony. <br />Roger Olsen Letter <br />The Marion Cluster Plat was submitted on February 22, 2006. The <br />applicant is Fowler Creek Trust. This applicant is a separate landowner <br />from the Springtree H development, which is currently on hold. The <br />Springtree II applicant is James K Schuler, who is a completely different <br />landowner from Fowler Creek Trust. <br />Irrigation Easement: <br />Yes there is a KRD lateral that ends prior to this proposal; which was <br />shown at the hearing. Where the KRD lateral ends at that point there is a <br />6 -foot wide easement running north along the property line for delivery of <br />water. The applicant has negotiated an easement for ingress and egress <br />and road construction. Said road shall meet the county requirements for <br />private roads and shall be placed within the 60 foot easement in such a <br />manner that it will not impact the irrigation easement. <br />Bonus Points: <br />1. 25 points for a Group Water System. <br />This project proposed a Group Water System instead of individual <br />wells. This qualifies for the 25 points pursuant to the Performance <br />Based Cluster Code (Ord. 2005-35). The application was <br />submitted and reviewed by County Staff for consistency and <br />processed this application pursuant to County Code. Furthermore <br />County Staff recommended approval, which provided more <br />consistency with the county code in which this application was <br />submitted under. <br />2. 25 points for placing 25% into Opens Space. <br />This qualifies for the 25 points pursuant to the Performance Based <br />Cluster Code (Ord. 2005-35).
