AGENDA STAFF REPORT
AGENDA DATE: October 6, 2026
ACTION REQUESTED: Request to Approve Transfer of Development Rights Conservation Easement
(TD-26-00003 Solar Dolar)
BACKGROUND: Project TD-26-00003 Solar Dolar is a transfer of development rights application. The
applicant wants to remove the development rights from one (1) parcel and place the
parcel in a conservation easement. The subject parcel is located at 1511 W Dolarway
Road. The parcel totals .33 acres and is wholly covered by critical areas and flood
plain. Per KCC17.13.020 frequently flooded areas are eligible to be a sending site.
After a review of the application materials and a site visit, staff have determined that
the parcel qualifies for the transfer of development rights. When signed and recorded,
the TDR conservation easement will create two (2) development right certificates. The
conservation easement is before you.
This action will create the certificates; however a separate receiving site application
would need to be submitted to redeem the TDR credits. Currently there is a moratorium
in place preventing the application for TDR Applications, therefore no new certificates
may be applied for, and no credits may be redeemed until after the moratorium is lifted.
