AGENDA DATE: October 20, 2026
ACTION REQUESTED: Request to Approve a Resolution to Authorize the
Chairman’s Signature on Third Letter Amending an
Interlocal Agreement between the Kittitas County Flood
Control Zone District and the Kittitas County Conservation
District.

BACKGROUND: The Kittitas County Flood Control Zone District and the
Kittitas County Conservation District entered into a
Interlocal Agreement to finalize the design of the Whiskey
Creek at Ellensburg Water Company Siphon Project and
provide construction support services. Kittitas County and
the Kittitas County Conservation District have determined
that construction support beyond the original scope will be
required. We are therefore requesting the total budget be
increased by $44,000 bringing the total Interlocal
Amendment amount to $182,110. This cost increase is
within the amount originally budgeted for project
construction.
Term 14 of the Interlocal Agreement allows the Agreement to be
modified or amended by written mutual agreement of the parties
This is the third amendment by letter. The first amendment
(Resolution 2026-056) amended the term of the agreement
to March 31, 2027. The second amendment amended
(Resolution 2026-108) increased the budget by $15,000.
INTERACTION: Public Works.
RECOMMENDATION: Move to Approve the Resolution to Authorize the
Chairman’s Signature on Third Letter Amending an
Interlocal Agreement between the Kittitas County Flood
Control Zone District and the Kittitas County Conservation
District.
HANDLING: Return two (2) original to Public Works.

RESOLUTION TO AUTHORIZE CHAIRMAN'S SIGNATURE ON THIRD LETTER
AMENDING AN INTERLOCAL AGREEMENT BETWEEN THE KITTITAS COUNTY FLOOD
CONTROL ZONE DISTRICT AND THE KITTITAS COUNTY CONSERVATION DISTRICT
WHEREAS: Resolution 2024-155 authorized Chairman Signature on an Interlocal Agreement between
the Kittitas County Flood Control Zone District and the Kittitas County Conservation
District for the Whiskey Creek at Ellensburg Water Company Siphon Project; and
WHEREAS: Term 14 of the Interlocal Agreement allows the Agreement to be modified or amended
by written mutual agreement of the parties; and
WHEREAS: Resolution 2026-056 authorized Chair’s signature on an amendment extending the term
of the agreement to March 31, 2027; and
WHEREAS: Resolution 2026-108 authorized Chair’s signature on an amendment adding $15,000 to
the project budget; and
WHEREAS: The Kittitas County Flood Control Zone District and the Kittitas County Conservation
District wish to amend the Interlocal Agreement to add $44,000 to the project budget to
provide additional construction support.
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners finds it in the best
interest of the public to authorize the Chairman to sign third letter amending the Interlocal Agreement
between the Kittitas County Flood Control Zone District and the Kittitas County Conservation District.

Re: Modification to Interlocal Agreement Between Kittitas County Flood Control Zone District and
Kittitas County Conservation District.
Dear Commissioner Wachsmith,
On November 16, 2024 the Kittitas County Conservation District and Kittitas County Flood Control
Zone District entered into an Interlocal Agreement for the purpose of working cooperatively to design
and manage construction for the Whiskey Creek at Ellensburg Water Company Siphon Project
(Kittitas County Resolution No. 2024-198). This interlocal agreement was amended first on March
17, 2026 (Kittitas County Resolution No. 2026-056) to extend the term to March 31, 2027, and
amended again on June 16, 2026 (Kittitas County Resolution No. 2026-108) to increase the total
authorized payment to $138,110.
Per Term 14 of this agreement, "the provisions of this Agreement may be modified or amended only
by written mutual agreement of the parties, executed by personnel authorized to bind each of these
parties."
May it be known that the undersigned parties, for good consideration, do hereby agree to increase
payment to complete the scope of work, by $44,000, from $13 8,110 to $182,110.
The parties reaffirm no other terms or conditions of the above -mentioned contract shall be negated or
changed as a result of this modification.
