BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO.2026- <br />RESOLUTION TO AUTHORIZE EXECUTION OF AN INTERLOCAL AGREEMENT <br />BETWEEN KITTITAS COUNTY AND THE STATE OF WASHINGTON <br />DEPARTMENT OF ECOLOFY FOR ADMINISTRATION AND ENFORCEMENT OF <br />CERTAIN WATER WELL CONSTRUCTION REGULATIONS <br />WHEREAS, RCW 39.34, the Interlocal Cooperation Act, provides the capability for public <br />agencies to cooperate for mutual advantage; and <br />WHEREAS, the Washington State Department of Ecology (Ecology) has legal authority to <br />enforce minimum standards for construction and maintenance of wells; and <br />WHEREAS, the County also has certain legal authority related to well construction and <br />maintenance; and <br />WHEREAS, Ecology desires to contract with the County via Interlocal Agreement to perform <br />work related to well tagging, sealing and decommissioning components pursuant <br />to Chapter 173-160 WAC; and <br />WHEREAS, Ecology and the County have agreed to the terms, including payment for services, <br />for providing such services as detailed in the Interlocal Agreement that is attached <br />hereto and hereby incorporated by this reference; and <br />WHEREAS, the Board of County Commissioners find that it is in the best interest of the <br />County, and all its citizens to enter the Interlocal Agreement. <br />NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas <br />County, Washington, authorizes execution of an Interlocal Agreement with the Washington State <br />Department of Ecology. <br />DATED this day of 2026, at Ellensburg, Washington. <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />Chair <br />
