KITTITAS COUNTY <br />COMMUNITY DEVELOPMENT SERVICES <br />AGENDA ITEM STAFF REPORT <br />AGENDA DATE: August 41, 2026 <br />TOPIC: Public Hearing to extend the moratorium regarding Kittitas County <br />Code Chapter 17.13 (Transfer of Development Rights) for one (1) <br />year, which includes a one (1) year work plan <br />ACTION REQUESTED: Request to approve Resolution. <br />BACKGROUND: Washington State Department of Commerce, in its March 271 and May <br />22°d, 2026 comment letter on the County's 60-day notice of intent to <br />amend development regulations, strongly recommended that Kittitas <br />County amend or rescind its current TDR program because <br />implementation guidelines are ambiguous and misapplication may have <br />the opposite effect of the program's intent, which is encouraging growth <br />in rural areas rather than directing it toward cities and Urban Growth <br />Areas consistent with the Growth Management Act. <br />The Board enacted an emergency moratorium for six (6) months on any <br />new Transfer of Development Rights applications by Resolution 2026- <br />101, as authorized by RCW 36.70A.390, on June 8', 2026. RCW <br />36.70A.390 also requires that a hearing be held within 60 days. CDS is <br />proposing to the Board of County Commissioners to consider extending <br />the moratorium for one (1) year as it's necessary, reasonable, to protect <br />the public health, safety, and welfare of Kittitas County. <br />INTERACTION: Kittitas County Community Development Services Department (CDS). <br />RECOMMENDATION: Approve Resolution with Exhibits extending the moratorium for one (1) <br />year. <br />ATTACHMENTS: Resolution & Associated Exhibits <br />LEAD STAFF: Chad Bala, Director <br />Page 1 of 2 <br />Community Development Services "Staff Report", 2026 <br />
