M1�E sTAP, o� <br />w a y Washington State K14078 <br />J <br />J �z Department of Corrections <br />�h� 1869 a�Y <br />THIS IN 1RA TA\'7 IE cC{OflfbRIEC` I[ONS COMPACT ("Compact" or <br />"Agreement") is made and entered into by and between the Washington State Department of Corrections, <br />hereinafter referred to as "WADOC," "DOC," or "Department," and Kittitas County, hereinafter referred to as <br />"County," pursuant to the authority granted by Chapter 72.76 RCW. <br />WHEREAS it is the purpose of this Compact to maximize the use of existing resources and to provide <br />adequate facilities and programs for the confinement, care, treatment, and employment of Incarcerated <br />Individuals. Department and County specifically find that the Agreement is necessary and desirable to <br />provide adequate housing and care or appropriate rehabilitation and treatment programs to the persons being <br />transferred. <br />NOW THEREFORE, in consideration of the terms and conditions contained herein, or attached <br />and incorporated and made a part hereof, Department and County agree as follows: <br />Article I <br />DEFINITIONS <br />Convicted Felony Incarcerated Individual - A person who has been convicted of a felony established <br />by state law and is eighteen years of age or older, or who is less than eighteen years of age, but whose <br />case has been transferred by the appropriate juvenile court to a criminal court pursuant to RCW <br />13.40.110 or has been tried in a criminal court pursuant to RCW 13.04.030(1)(e)(v). <br />Extraordinary Medical Expense - Any medical expense beyond that which is normally provided by <br />contract medical providers or other health care providers at the Facility of the Receiving Jurisdiction. <br />Facility - Any state correctional institution, camp, or other unit established or authorized by law under <br />the jurisdiction of DOC; any jail, holding, detention, special detention, or correctional Facility operated <br />by County for the housing of adult Incarcerated Individuals; or any contract Facility, operated on behalf <br />of either County or DOC for the housing of adult Incarcerated Individuals, <br />Incarcerated Individual - A person who has been charged with and/or convicted of an offense <br />established by applicable statute or ordinance. <br />Incarcerated Individual Day - Any day an Incarcerated Individual is in the custody of the Receiving <br />Jurisdiction including the first day an Incarcerated Individual is delivered to the Receiving Jurisdiction, <br />An Incarcerated Individual Day ends at midnight of the Incarcerated Individual's release or return to <br />the custody of the Sending Jurisdiction. An Incarcerated Individual Day shall not include any day that <br />is by state law the financial responsibility of the Receiving Jurisdiction or any other jurisdiction. <br />Receiving Jurisdiction - Department or County, whichever is being sent an Incarcerated Individual <br />from the other Party. <br />Washington State K14078 Page 1 of II <br />Department of Corrections 2612AD <br />
