I <br />KITTITAS COUNTY PORT.BOWERS FIELD <br />Lease Amendment <br />THIS AMENDMENT TO LEASE is made and dated this <br />2026,by and between KITTITAS COUNTY, a municipal corporation in the State of <br />Washington, hereinafter referred to as the LESSOR, and RBR INVESTMENTS AVIATION <br />LLC, and hereinafter referred to as the LESSEE. <br />WITNESSETH: <br />WHEREAS, by a"ssignment of lease, LESSOR and LESSEE entered into a Lease on <br />May 13, 2024 forLotH-24 of the Kittitas County Amended Binding Site Plan, a copy of said <br />assignment of lease is attached hereto and by this reference incorporated herein; and <br />WHEREAS, assignment of lease was between Mark and Linda Menill (Assignor) and <br />RBR Investments Aviation LLC (Assignee) and Kittitas County; and <br />WHEREAS, Assignee assumed and agreed to perform and fulfii all terms, covenants, <br />conditions, and obligations as LESSEE under the lease; and <br />WHEREAS, assigned Lease entered into on October 1,2022 identified athirty-year (30) <br />lease term with an identified end year of 2032; and <br />WHEREAS, LESSOR and LESSEE desire to amend said lease to reflect the full thirty- <br />year (30) term, to identify an end year of 2052. <br />NOW, THEREFORE,IT IS HEREBY AGREED by and between the parties to correct <br />Scrivenor's error in the Lease Term as follows: <br />l) "Recitals" The first paragraph of fhe.ASSIGNMENT OF'LEASE will reads as follows: <br />Mark and Linda Menill entered into a Lease on the ist day of October 2022, with Kittitas <br />County for the lease of LotH-24 of the Bowers Field Airport Binding Site Plan 2nd Amendment <br />BS-21-00001 through December 3lst,2052. A copy of said Lease is attached hereto as Exhibit <br />A and is hereinafter referred to as the "Lease". <br />2) "Term" Section 2.lrBffective Date and Initial Term, of HANGAR GROUND LEASE -- <br />will read as follows: <br />The Lease shall be effective as of the Lease Date. 'I'he term of this Lease shall be for a period of <br />thirty (30) years commencing on the Lease Date as provided in Exhibit C, if attached, and ending <br />on December 31, 2052, such period being the "Initial Term" rrr "Tlerul" and including any <br />extensions as provided in Section 2.2.
