CITIZEN COMMENTS
Pat Kelleher provided comment regarding the Roslyn Water Project and
expressed concern that the project does not appear to have a secured
water source and stated that securing a reliable water supply should
be a priority before further investment. Pat Kelleher referenced
prior utility infrastructure issues in other communities and urged
the County to ensure long-term water supply reliability.
An e-mail from Pat Kelleher to the Board.of County Commissioners
dated March 9, 2026 is attached hereto.
REQUEST TO APPROVE A RESOLUTION AUTHORIZING BOARD CHAIR SIGNATURE ON
DEEDS FOR ADDITINOAL RIGHT OF WAY ON BULLFROG ROAD
Joshua Fredrickson requested the Board of County Commissioners
approve a resolution authorizing the Board Chair to sign deeds for
acquisition of additional right-of-way on Bullfrog Road.
Joshua Fredrickson explained that the request is associated with the
Bullfrog Flats development in the City of Cle Elum. Although the
development is processed through the City of Cle Elum, Kittitas
County has jurisdiction over Bullfrog Road. A traffic study
identified impacts from the development, including the need for a
roundabout at one of the proposed intersections.
The roundabout would be constructed at the developer's expense,
subject to County review and approval. Joshua Fredrickson stated that
the existing right-of-way is approximately 60 feet, which is
insufficient for the proposed roundabout. The developer worked with
2026-03-09 MINUTES
adjacent property owners to obtain additional right-of-way, and deeds
for those acquisitions were included in the Board materials.
Joshua Fredrickson further explained that the County would own and
maintain the roundabout pavement surface, while certain related
improvements such as lighting and utilities would remain outside
County ownership.
Vice Chairman Brett Wachsmith moved to approve Resolution 2026-052
and Commissioner Laura Osiadacz seconded the motion. Motion passed.
PORTION OF INNSBRUCK DRIVE ROAD VACATION REQUEST
Joshua Fredrickson briefed the Board of County Commissioners
regarding an application received to vacate a portion of Innsbruck
Drive right-of-way.
Joshua Fredrickson briefed the Board of County Commissioners on the
history of the roadway, explaining that Innsbruck Drive was part of
the Hyak Estates plat recorded in 1967 and is a dead-end road. The
roadway later became County right-of-way following a 1996 Road
Improvement District project, after which the County assumed
ownership and maintenance responsibilities.
The request was submitted by the owner of Lot 71, located at the end
of the street, seeking vacation of a portion of Innsbruck Road in
front of the residence at the end of the Road. Joshua Fredrickson
explained that the requested area extends to the edge of pavement and
would affect the area that could otherwise support a future cul-de-
sac or turnaround.
Joshua Fredrickson stated that Public Works does not currently
support the vacation request, because vacating the area could limit
future roadway improvements, snow removal operations, maintenance
needs, and emergency vehicle access. Joshua Fredrickson noted,
however, that the application appears sufficient to move through the
required process, including a future public hearing and preparation
of a director's or engineer's report.
Board discussion included review of the site layout, remaining
undeveloped lots, roadway access needs, and operational concerns
including emergency response and snow removal. The Board of County
Commissioners asked that Public Works conduct additional review and
return the matter to a future study session before moving forward.
2026-03-09 MINUTES
KITTITAS COUNTY CONFERENCE OF GOVERNMENTS PUBLIC FACILITIES FUND 2026
Joshua Fredrickson presented recommendations from the Conference of
Governments (COG) regarding Public Facilities Fund (Fund 108).
City of Roslyn - Clear Well Project
Joshua Fredrickson presented a recommendation for funding related to
the City of Roslyn clear well replacement and repair project.
Roslyn's water system uses two clear wells for chlorine contact time
and pressure equalization. Joshua Fredrickson reported that one clear
well requires full replacement and the second requires substantial
repair. The structures were described as being in poor condition,
with cracking, leakage, and visible deterioration.
Joshua Fredrickson noted that Roslyn's water system also serves Water
District No. 2 / Ronald. The total project cost was reported at just
over $1.5 million. COG recommended funding of up to $1.5 million.
Board of County Commissioners discussed the condition of the
facilities, the significance of the infrastructure need, available
funding, and the importance of ensuring long-term utility
reliability. Joshua Fredrickson explained that the amount would be
capped and that final costs would depend on bid results and any
additional funding sources obtained.
CWU Technology Transfer Center / Old Heat Building
Joshua Fredrickson also presented to the Board of County
Commissioners a COG recommendation for $20,000 for the CWU Technology
Transfer Center / Old Heat Building project. Joshua Fredrickson
explained that previous feasibility work had been supported through
CERB funding, and that the next phase would include updated
architectural planning, warm shell planning, and development of a
capital stacking plan to support future public -private investment.
Joshua Fredrickson described the project as an economic development
effort intended to connect University research and faculty expertise
with industry and innovation opportunities.

Roslyn Water Project — Concerns
The current COG recommendation provides very little leverage for the project. The proposal requests $1,500,000 in COG
funds with only $125,000 in other funding, meaning the overwhelming share of funding would come from distressed
sales tax dollars.
The funding request is primarily to repair an existing water system that suffers from years of deferred maintenance.
While maintenance is necessary, the proposal does not address the core structural concern: the water district's supply
is subject to curtailment.
Before significant public funds are committed to infrastructure repairs, a firm and reliable water source should be
secured first. Investing heavily in storage or distribution improvements is questionable if the system may not have water
available during curtailment periods.
The proposal also lacks several basic pieces of information:
• No discussion of how many customers are served by the water district.
• No project implementation plan or timeline.
• No explanation of what specific invoices Public Works would pay or when work would occur.
Under the current arrangement, County Public Works serves only as contract administrator and invoice processor,
yet no clear scope of work has been presented.
Given the regional nature of water planning, City of Ellensburg Water Services should be consulted through the
COG process to review the proposal and provide guidance on best practices and potential long-term solutions.
As presented, the project resembles putting Flex Seal on a leaking tank. Yet if curtailment occurs this summer, the tank
may have no water in it to store.
Until the fundamental issue of secure water supply is addressed, committing $1.5 million in public funds appears
premature.

DISCUSSION:
At their February 18, 2026 regularly .scheduled COG meeting, COG received requests for
funding of two projects. funding request is for the use of the Distressed County Sales and
Use Tax.
The City of Roslyn presented to COG their proposal for repair and replacement of the
City's clear wells. The City of Roslyn has two clear wells which are part of their water

infrastructure which serves both the City of Roslyn and Water District 2 (Ronald). The
clear wells provide disinfection contact time and equalizing storage for their water
system. Repairs are required to one clear well and the second clear well needs to be
replaced. The City of Roslyn was awarded $125,000.00 from the Public Works Board to
assist with the project. COG supported the City of Roslyn request of up to S1,500,000.00
of Distressed County Sales and Use Tax for repairs and replacement of their ,clear wells.
Also at the February 18, 2026 regular meeting of COG also received an update of the
C'WIJ Technology Transfer Center Feasibility (Old Heat) project. COG initially
supported the project through matching funds to the Washington State Community
Economic Revitalization Board (CERB) grant.. COG continued to express their support of
the project by recommending an additional S20,O00.00 of Distressed County Sales and
Use Tax for expanding work on the project. This work include: a construction cost
estimate for developing architecture plans for the Old Heat building, into a warm shell and
developing the capital stacking frarnework which will help develop private -public
partnerships for future. build out of the building.

BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
AGENDA DATE: March 9, 2026
ACTION REQUESTED: Request to approve a Resolution authorizing Board Chair signature on
deeds for additional Right of Way on Bullfrog Road
BACKGROUND: In 2002 the Cle Elum City Council approved a Master Plan and a
Development Agreement to govern the future development of land
located in the western part of Cle Elum, for a project known as
Bullfrog Flats. A portion of the project abuts Bullfrog Road, a County
Road. This Bullfrog Flats development is a mixed -use development
including residential units.
On March 25, 2025 the Cle Elum City Council approved the master
plat, boundary line adjustment and three preliminary plat phases
submitted by Bullfrog Flats, LLC.
To mitigate traffic impacts resulting from the development on
Bullfrog Road, a roundabout is to be constructed at one of the
entrances to the development. Public Works has been working with
the developer and their engineer on the roundabout plans. Additional
right-of-way has been identified as needed for the construction of the
project.
Currently Bullfrog Road has 60-feet of right-of-way, which is
insufficient for the proposed roundabout. Bullfrog Flats, LLC owns
property on the south side of Bullfrog Road and Suncadia Community
Council owns property on the north side of the road. The developer
has worked to obtain additional right-of-way to accommodate the
roundabout and desires to provide this to the County. The additional
right-of-way area will be sufficient to construct and maintain the
roundabout.
INTERACTION: Public Works, Prosecuting Attorney Office, Bullfrog Flats LLC
RECOMMENDATION: Approve a resolution authorizing Board Chair signature on deer.
HANDLING: Return One original to Public Works

WHEREAS: Through development review traffic mitigation by the development is required on
Bullfrog Road; and
WHEREAS: The developer of Bullfrog Flats desires to construct the roundabout on Bullfrog Road to
provide for the required traffic mitigation included in the project requirements; and
WHEREAS: Current County Road right-of-way is insufficient for the construction of the roundabout;
and
WHEREAS: Bullfrog Flats LLC owns the property on the south side of the road and Suncadia
Community Council owns the property on the north side of the road; and
WHEREAS: Bullfrog Flats LLC and Suncadia Community Council have freely provided deeds to

KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: March 9, 2026
TOPIC: Portion of Innsbruck Drive Road Vacation Request
ACTION REQUESTED: Direct Staff to prepare enabling documents and to
schedule a Public Hearing
LEAD STAFF:
Joshua Fredrickson
RECOMMENDATION:
Prepare enabling documents and schedule the required public hearing regarding the
proposed right-of-way vacation.
BRIEFING SUMMARY:
• Innsbruck Drive was established as part of the Hyak Estates Plat
• Hyak Estates Plat dedicated to the use of the public all roads, streets and alleys
within the plat
• Kittitas County Resolution 96-40 created a Road Improvement District (RID) for
an area which included the Hyak Estates Plat
• Once road improvements were complete, the roads within the RID became part of
the County Road System
• Lot owner desires vacation of a portion of the right-of-way
• Public Works (PW) does not support the requested road right-of-way vacation
• Kittitas County Code Chapter 12.10 and RCW 36.87 identifies road vacation of
County Roads
BACKGROUND:
The Hyak Estates Plat was approved in 1967 which included 136 lots and multiple
roadways, including Innsbruck Drive (Exhibit 1). The original plat dedicated the roads,
streets and alleys within the plat for the use of the public. At the time of plat approval, the
County did not adopt the roadways as on -system roadways. In 1996 a Road Improvement
District (RID) was approved which included the Hyak Estates Plat. Through resolution
96-40 the RID was established and upon completion of the improvements the roadways
within the RID became part of the County Road System. Through the RID process,
Innsbruck Drive became County Right -of -Way. Innsbruck Drive is a dead-end roadway
which does not have a standard turnaround constructed.
Public Works Study Session Staff Report 2026
DISCUSSION:
An application to vacate a portion of the Innsbruck Drive right-of-way was received by
Public Works (Exhibit 2). The location of the proposed vacation is the area fronting Lot
71 of the Hyak Estates Plat. Kittitas County Code 12.10 indicates that a Public Hearing
would be used to consider the road vacation request. At the Public Hearing a Director's
Report will be presented. The Director's Report is to include the following:
1. Whether the County Road should be vacated and abandoned
2. Whether the same is in use or has been in use
3. The condition of the road
4. Whether it will be advisable to preserve it for the County Road system in the
future
5. Whether the public will benefit by its vacation and abandonment
6. A determination by appraisal of the fair market value of the area sought to be
vacated
7. The classification of the road area according to the type and number of
expenditures made and the nature of the County's interest therein
8. Whether the proposed area to be vacated contains utilities
9. All other matters which will be of interest to the Board
The area sought for vacation is currently right-of-way and does not have a road
constructed. This is located at the end of the road and the right-of-way currently
dedicated is a 45-ft radius from the center of the roadway. Vacation of the right-of-way
would preclude any future improvements to the turnaround.
FISCAL IMPACTS:
The applicant has paid PW's road vacation application fee of $3,888.00

Location (Any of the following please be as accurate as possible)
Kittitas County Public Works is willing to assist with this process if the applicant or designated agent
requests assistance.
The right-of-way proposed for vacation consists of a portion of an unbuilt cul-de-sac/right-of-way
dedicated as part of the Hyak Estates subdivision but never constructed or improved as a roadway.
The area proposed for vacation is shown and described on the "Proposed Right of Way Vacation"
survey exhibit, Job No. 24591, prepared by Encompass Engineering & Surveying, which is attached
hereto and incorporated by this reference (Exhibit A).
411 N. Ruby Street, Suite 1 TEL (509) 962-7523
Ellensburg, WA 98926 FAX (509) 962-7663
The proposed vacation area abuts the following parcels:
- Tax Parcel No. 808435 (Petitioner — Lot 71)
- Tax Parcel No. 818435 (Lot 72)
- Tax Parcel Nos. 768435, 778435, 788435, 798435 (Lots 67-70)
Reason for Request:
The subject portion of the county right-of-way is useless as part of the county road system within
the meaning of RCW 36.87.010 and KCC 12.10.030, for the following reasons:
a. This portion of the roadway has never been constructed, paved, or improved in any manner;
b. The right-of-way has remained unused for vehicular or public travel for decades;
c. The topography of the site consists of a steep hillside, making future road construction
impractical and cost -prohibitive;
d. Adequate roadway access and vehicle turnaround areas exist on the improved roadway
immediately north of the subject area.
7. The continued retention of the right-of-way imposes a maintenance and liability burden on the
County without providing a corresponding public benefit.

KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: March 9, 2026
TOPIC: Kittitas County Conference of Governments Public Facilities Fund 2026
Project Award
ACTION REQUESTED: Direct Staff to prepare enabling documents
LEAD STAFF:
Josh Fredrickson
RECOMMENDATION:
Direct Staff to prepare enabling documents including contracts and award for funding
BRIEFING SUMMARY:
• Kittitas County receives Distressed County Sales and Use Tax (0.09 funds)
• Funds are utilized to support economic development activities and construction of
public facilities
• The Conference of Government (COG) makes recommendations for funding
proj ects
• Funding for City of Roslyn clear wells and CWU Technology transfer projects are
currently proposed
BACKGROUND:
As part of SB 5740 in 1997 the State included the Rural Counties Public Facilities Sales
Tax (RCW 82.14.370), known as the 0.09% rural sales tax. These funds are for the
purpose of supporting economic growth and financing Public Facilities including but not
limited to, bridges, roads, domestic and industrial water facilities, sanitary sewer
facilities. Kittitas County's Public Facilities Fund (108) provides the mechanism for
investing distressed county sales and use tax in Kittitas County. These funds are utilized
to support economic development activities and construction of public facilities.
Kittitas County Conference of Governments (COG) recommends award of Funds which
are managed in Fund 108 by Public Works.
DISCUSSION:
At their February 18, 2026 regularly scheduled COG meeting, COG received requests for
funding of two projects.

COG supported the City of Roslyn request of up to $1,500,000.00
of Distressed County Sales and Use Tax for repairs and replacement of their clear wells.
Also at the February 18, 2026 regular meeting of COG also received an update of the
CWU Technology Transfer Center Feasibility (Old Heat) project. COG initially
supported the project through matching funds to the Washington State Community
Economic Revitalization Board (CERB) grant. COG continued to express their support of
the project by recommending an additional $20,000.00 of Distressed County Sales and
Use Tax for expanding work on the project. This work includes a construction cost
estimate for developing architecture plans for the Old Heat building into a warm shell and
developing the capital stacking framework which will help develop private -public
partnerships for future build out of the building.
FISCAL IMPACTS:
Funding is available in the Public Facilities Fund (Fund 108)
