BOARD OF COIINTY COMMISSIONERS COUNTY OF KITTITAS STATE OF WASHINGTON RESOLUTION No. ,x. rrffr*31 AUTHORIZING THE CHATR OF COTINTY COMMISSIONER'S SIGNATIIRE ON THE MUTUAL RESCISSION AND RELEASE OF WATER RIGHT PURCHASE AND SALE AGREEMENT WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State Department of Ecology and administered by the Public Works Department; and WHEREAS: On March 13,2023, Kittitas County entered into a water right purchase and sale agreement for water right certificate No. S4-84269-J, which was ratified by Resolution 2023-058; and WIIEREAS:On March 4,2025, Kittitas County and sellers amended this purchase and sale agreement, so that the purchased water right would be the consumptive and non-consumptive portions associated wrth 2.5 acres of irrigation water for S4-84268-J instead of 34-84269- J; and WIIEREAS: The Chair of County Commissioner's signature on the first amendment to water right purchase and sale agreement was ratified by Resolution2025-067; and WIIEREAS: The Seller of said water right has requested to terminate the water right purchase and sale agreement; and WHEREAS:Kittitas County and Seller have mutual agreement to rescind the prior water right purchase and sale agreement and release all parties to that prior water right purchase and sale agreement including any and all obligations under said agreement; NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best interest of the public, does authorue the Chair of County Commissioner's Signature on the Mutual Rescission and Release of Water Right Purchase and Sale Agreement.
