BOARD OF COUNTY COMMISSIONERS COUNTY OF KITTITAS STATE OF WASHINGTON RESOLUTTON No. 2o2s- Aa€ A RESOLUTION TO AUTHORIZE EXECUTION OF AN INTERLOCAL AGREEMENT BETWEEN KITTITAS COUNTY AND CITY OF ELLENSBURG FOR THE POOLING OF OPIOID FUNDS RESULTING FROM THE SETTLEMENT OF CLAIMS AGAINST PHARMACEUTICAL SUPPLY CHAIN PARTICIPANTS WHEREAS, the Interlocal Cooperation Act, as amended, and codified in Chapter 39-34 of the Revised Code of Washington ("RCW'), provides for public agencies to enter into agreements for joint or cooperative action authorized under that chapter; and WHEREAS,this Interlocal Agreement (ILA) is between Kittitas County (KC) and the City of Ellensburg (COE) for the pooling of funds received by the COE pursuant to its execution of the One Washington Memorandum of Understanding with those received by Kittitas County pursuant to its execution of the same agfeement' COE and KC are local govemments who have executed both the One Washington Mutual Memorandum of Understanding Between Washington Municipalities and the Memorandum of Understanding between the Greater Columbia Region Municipalities to Establish an Opioid Abatement Counsel to establish a framework for the distribution and oversight of Opioid Funds (as the term is defined in both agreements); and WHEREAS, the City of Ellensburg desires to pool the funds it receives with the funds Kittitas County receives in order to best serve the residents of Ellensburg and Kittitas County; and WHEREAS, it is mutually beneficial for the COE and KC to enter into this ILA; and WHEREAS. the term of the ILA shall be from the last date of signature until the COE no longer receives Opioid Funds pursuant to the above listed agreements, unless the ILA is terminatedearly or its term is extended as provided within this ILA; and WHEREAS. KC and COE agree to designate a set amount of Opioid Funds available from its settlement account for each funding cycle, will provide staff support and perform other duties as set forth in ILA, which is attached hereto and incorporated bY reference; and WHEREAS, Both parties agree that each will follow the requirement of the underlying MOUs that each has executed and agreed to abide by; and WHEREAS, Both parties agree to fund the Kittitas County Public Health Department Harm Reduction Program outside the public request for proposal process I the amount of $ 100,000.00 per year, for five (5) years, beginning January 1,2026; and WHEREAS, the point of contact for the City of Ellensburg with be Heidi Behrends
