BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTTON No. 2o2s- Aa€ <br />A RESOLUTION TO AUTHORIZE EXECUTION OF AN INTERLOCAL <br />AGREEMENT BETWEEN KITTITAS COUNTY AND CITY OF ELLENSBURG FOR <br />THE POOLING OF OPIOID FUNDS RESULTING FROM THE SETTLEMENT OF <br />CLAIMS AGAINST PHARMACEUTICAL SUPPLY CHAIN PARTICIPANTS <br />WHEREAS, the Interlocal Cooperation Act, as amended, and codified in Chapter 39-34 of the <br />Revised Code of Washington ("RCW'), provides for public agencies to enter <br />into agreements for joint or cooperative action authorized under that chapter; <br />and <br />WHEREAS,this Interlocal Agreement (ILA) is between Kittitas County (KC) and the City of <br />Ellensburg (COE) for the pooling of funds received by the COE pursuant to its <br />execution of the One Washington Memorandum of Understanding with those <br />received by Kittitas County pursuant to its execution of the same agfeement' <br />COE and KC are local govemments who have executed both the One <br />Washington Mutual Memorandum of Understanding Between Washington <br />Municipalities and the Memorandum of Understanding between the Greater <br />Columbia Region Municipalities to Establish an Opioid Abatement Counsel to <br />establish a framework for the distribution and oversight of Opioid Funds (as the <br />term is defined in both agreements); and <br />WHEREAS, the City of Ellensburg desires to pool the funds it receives with the funds <br />Kittitas County receives in order to best serve the residents of Ellensburg and <br />Kittitas County; and <br />WHEREAS, it is mutually beneficial for the COE and KC to enter into this ILA; and <br />WHEREAS. the term of the ILA shall be from the last date of signature until the COE no <br />longer receives Opioid Funds pursuant to the above listed agreements, unless the <br />ILA is terminatedearly or its term is extended as provided within this ILA; and <br />WHEREAS. KC and COE agree to designate a set amount of Opioid Funds available from its <br />settlement account for each funding cycle, will provide staff support and <br />perform other duties as set forth in ILA, which is attached hereto and <br />incorporated bY reference; and <br />WHEREAS, Both parties agree that each will follow the requirement of the underlying <br />MOUs that each has executed and agreed to abide by; and <br />WHEREAS, Both parties agree to fund the Kittitas County Public Health Department Harm <br />Reduction Program outside the public request for proposal process I the amount <br />of $ 100,000.00 per year, for five (5) years, beginning January 1,2026; and <br />WHEREAS, the point of contact for the City of Ellensburg with be Heidi Behrends
