KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />AGENDA STAFF REPORT <br />AGENDA DATE: November 18, 2025 <br />ACTION REQUESTED: Request to Approve the Resolution to Rescind and Release <br />Water Rights Purchase and Sale Agreement and Authorize <br />Chair Signature on the Mutual Rescission and Release of <br />Water Rights Purchase and Sale Agreement <br />BACKGROUND: Kittitas County maintains a water banking program <br />accepted by the Washington State Department of Ecology <br />(WDOE) and administered by the Public Works <br />Department. On March 14, 2023, Kittitas County entered <br />into a Water Rights Purchase and Sale Agreement with <br />David W. Adams, Leann Adams, William Craig, and <br />Constance Craig to purchase the consumptive and non - <br />consumptive portions of the Water Right with a priority <br />date of June 30, 1871 and assigned certificate No. S4- <br />84269-J with said agreement being amended on March 4, <br />2025. <br />The Seller(s) have since requested to rescind the Water <br />Rights Purchase and Sale Agreement for said water right <br />and Kittitas County has drafted the necessary <br />documentation to accommodate said request. The original <br />Water Rights Purchase and Sale Agreement and said <br />Amendment was not finalized and there is mutual <br />agreement to rescind the Water Rights Purchase and Sale <br />Agreement and all obligations under that agreement. <br />INTERACTION: Public Works. <br />RECOMMENDATION: Move to approve the Resolution Rescind and Release <br />Water Rights Purchase and Sale Agreement and Authorize <br />Chair Signature on the Mutual Rescission and Release of <br />Water Rights Purchase and Sale Agreement. <br />HANDLING: Return two (2) originals to Public Works. <br />ATTACHMENTS: Resolution; Mutual Rescission and Release of Water Right <br />Purchase and Sale Agreement <br />LEAD STAFF: Arden Thomas, Water Resource Program Manager. <br />
