\ <br />BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTIO N No. 202s- 15 <br />A RESOLUTION TO AUTHORIZE EXECUTION OF AN INTERAGENCY <br />AGREEMENT BETWEEN KITTITAS COI.INTY AND THE DEPARTMENT OF <br />NATURAL RESOURCES <br />WHEREAS, the Interlocal Cooperation Act, as amended, and codified in Chaptet 39.34 of the <br />Revised Code of Washington ("RCW''), provides for public agencies to enter <br />into agreements for joint or cooperative action authorized under that chapter; <br />and <br />WHEREAS. The Washington State Department of Natural Resources (DNR) and Kittitas <br />County wistr to enter into this interagency agreement (IAA) for fumishing <br />necessary personnel, equipment, material and/or services and otherwise do all <br />things tt"""5ury for and incidental to performing the work set forth in Exhibit A <br />- Scope Work, of the IAA, in support of wildfire or other emergency response; <br />and <br />WHEREAS, puy for the work provided is established under RCW 39.34.130 and the pay for <br />services shall be based on the rates and terms described in Exhibit A - Scope of <br />Work, of the IAA and invoices shall be submitted according to the process <br />outlined in Exhibit B - Payment Requirements; and <br />WHEREAS, Kittitas County shall submit reimbursement requests to DNR withing one <br />hundred twenty (120) days of demobilizationof each incident; and <br />WHEREAS, the period of performance under this IAA is from the start date, or date of <br />execution, whichever is later, through the end of the contract term; and <br />WHEREAS. Kittitas County shall maintain books, records, documents and other evidence, to <br />sufficiently document all direct and indirect costs incurred by it doing the work <br />in providing the services. Kittitas County shall provide third parly notice to <br />DNR in the event of a Public Records Act request made for any records relating <br />to the work associated with this IAA; and <br />WHEREAS, data from this agreement is considered "work for hire" as defined by Title 17 <br />U.S.C. Section 101 and shall be owned by Kittitas County. This IAA is attached <br />hereto and incorporated by reference in total. <br />NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the <br />best interest of the public, does hereby authorize the Boards' signature on an Interagency <br />Agreement between Kittitas County and the Washington State Department of Natural <br />Resources. <br />DATED this 9r^day of 2025, at Ellensburg, Washington
