Agreement Number: K5060- 1 STATE OF WASHINGTON DEPARTMENT OF AGRICULTURE FAIRS PROGRAM AMENDMENT 1 TO AGREEMENT K5060 The Washington State Department of Agriculture (WSDA) Agreement K5060 by and between WSDA and Kittitas County is amended under the provisions of the amendments clause and by mutual consent of all parties. Agreement K5060, executed March 26, 2024, awarded $250,000 to Kittitas County to design and lay out utilities for a new RV Park. Subsequently, Kittitas County notified WSDA that an extension on the project completion date would be necessary because of delays related to the electrical work due to ongoing negotiations with the City of Ellensburg regarding the scope of power line upgrades and location, the transition from single-phase to three-phase power and future EV charging locations (new code requirement). The GRANT END DATE, PROJECT COMPLETION DATE, QUARTERLY REPORTS and LACK OF ADEQUATE PROGRESS sections are amended as follows [in bold]: 7. Grant End Date – June 30, 2025. 9. Project Must Be Completed By – June 30, 2025. 11b.Quarterly Reports – By May 31, 2025, Grantee must affirm in writing that the project will be completed by June 30, 2025, unless Grantee has prior submitted a Certified Project Completion Report. 12. Lack of Adequate Progress – Grantee’s inability to affirm by May 31, 2025, that the project will be complete by June 30, 2025, is a basis for WSDA to terminate the Agreement in whole or in part for cause as provided in Section 27. At WSDA’s discretion, the parties may modify this Agreement in lieu of termination.
