LEASE <br />THIS LEASE AGREEMENT is made and entered into by and between The City of Cle Elum, <br />hereinafter referred to as the LESSOR, and Kittitas County Sheriff's Office, hereinafter referred to as the <br />LESSEE. This lease will become effective as of the last signature date below (the "Effective Date"). <br />The Lessor hereby agrees to lease to the Lessee, and the Lessee hereby agrees to lease from the Lessor, <br />the following described real property, to be used primarily to support Lessee's Search and Rescue operations: <br />Lots 21 through 27 of Block 11, Hazelwood Addition to the Town of Cle Elum, as recorded May 18, <br />1888, in Book 1 of Plats, Page 45. <br />Kittitas County Assessor Parcel Numbers 753735, 753735 and 763735 in Cle Elum, WA, Kittitas <br />County, State of Washington. <br />Terms of Said Lgase are as follows: <br />1. TERM: The term of this lease shall be for two (2) years and will commence on the 1st day of January <br />2025 and terminate on the 31st day of December, 2026, except as otherwise provided hereunder. <br />(a) Lessee and Lessor agree that the parties may modify the terms of this lease, in whole or in part, <br />including but not limited to modifying the area of land covered by this lease, the rental due, the <br />term of duration of this lease and/or any' other term or condition of this lease, but only upon such <br />terms as are mutually agreed upon in writing. <br />(b) In the event that Lessor finds it necessary to terminate this lease for reasons not reasonably <br />anticipated at the time of entering into the lease, Lessor shall do so only upon one hundred twenty <br />(120) days' written notice, notifying Lessee at Lessee's address of record, that the lease is being <br />terminated. Lessee may terminate this lease early, for any reason, with one hundred twenty (120) <br />days' notice to Lessor at its address of record. <br />(c) In the event that the lease is terminated, all rents shall be pro -rated to the date Lessee shall have <br />restored the premises to the Lessor in accordance with the terms of the lease agreement governing <br />Lessee's duties to restore the premises to Lessor upon expiration of the lease term. <br />(d) It is further agreed that any modification or termination of this lease pursuant to the terms of the <br />lease shall not give rise to any cause of action for damages or any other form of relief. <br />(e) In the event of any early termination hereunder, Lessee understands that other than a refund of <br />any unearned rent prorated to the date Lessee has restored the premises to Lessor, Lessee shall <br />have no claim for compensation as occasioned by said modification or termination, unless <br />otherwise specified elsewhere in this lease. <br />2. RENT: The rental rate under this lease is twenty-five hundred dollars ($2,500.00) per month, which shall <br />be invoiced and paid quarterly. Notwithstanding the foregoing, the rent for the first and second quarters <br />of 2025 shall be due thirty (30) days after both parties have signed this lease agreement. For the remainder <br />of the lease term, rent shall be due on or before the 1st day of each calendar year quarter (i.e., July 1st, <br />October 1st, January 1st, April 1st). <br />3. UTILITIES: The Lessee shall pay for all utility services supplied to the premises. <br />City of Cle Elum/Kittitas County Sheriff Lease <br />
