ROAD USE AGREEMENT BETWEEN KITTITAS COUNTY PUBLIC WORKS AND <br />THE KITTITAS COUNTY SHERIFF'S OFFICE <br />This agreement is entered into as of this 9 day of MA y , 2025 between Kittitas <br />County Public Works (Public Works), a Washington State Municipal Corporation, and Kittitas <br />County Sheriff's Office (Sheriff's Office), a Washington Corporation; <br />RECITALS <br />1. The County owns certain right-of-way that may be suitable for the Deployment of Flock Safety <br />Cameras; specifically, right-of-way on: <br />1.1. West Sparks Road ( approximately MP 0.10). <br />1.2. Canyon Road (approximately MP 2.25) <br />1.3. Bullfrog Road (approximately MP 0.10) <br />1.4. Golf Course Road (approximately MP 1.20) <br />1.5. Vantage Highway (approximately MP 2.43) <br />1.6. Umptanum Road (approximately MP 1.00) <br />2. All devices shall be set up outside of the Clear Zone and in an area approved by Public Works. <br />3. Cameras will be installed and left in place 24 hours a day. The Sheriff's Office will give the <br />County Engineer notice of the month when cameras will be installed, and at least 48 hours <br />notice prior to performing maintenance activities. <br />4. In the event Public Works requires the devices to be moved to accommodate Public Works' <br />activities, the Sheriff's Office shall relocate the device to an approved location. <br />5. Sheriff's Office will not deviate from request submitted. <br />6. Public Works does not warrant the property is fit for the purposes contemplated. Sheriff's <br />Office is responsible for examining the property before each use and making the determination <br />that it meets their needs and intended use. <br />7. In the event the Cameras, or the associated apparatus are damaged in any way, the Sheriff s <br />Office shall be responsible for any necessary maintenance or replacement. <br />AGREEMENT <br />1. Property Use. The Parties agree that Sheriff's Office rights are limited to the uses specified <br />to said right-of-way and that the Sheriff's Office may not install additional cameras without <br />amending this agreement. <br />1 <br />
