BOARD OF' COT]NTY COMMISSIONERS <br />COT]NTY OF KITTITAS <br />STATE OF'WASHINGTON <br />RESOLUTION NO. 2025- O&I <br />AUTHORIZING AN AMENDMENT TO THE RANCII AT SWAUK CREEK DEVELOPMENT <br />AGREEMENT (DA-24-00001) TO CORRECT SCRTVENER'S ERRORS. <br />WHEREAS: <br />WIIEREAS: <br />WHERBAS: <br />WIIEREAS: <br />WHEREAS: <br />The County approved Resolution No.2024-0165 to authorize the Ranch at Swauk Creek <br />Development Agreement (DA-24-00001) on September 17,2024, by and between Kittitas County, <br />a political subdivision of the State of Washington ("County" and Ranch on Swauk Creek LLC, a <br />corporation organized under the laws of the State of Washington ("Developer"). This agreement <br />was made pursuant to Revised Code of Washington ("RCW') 36.708.170 and Kittitas County <br />Code ("KCC") Chapter l5A.ll. <br />The County seeks to amend the Development Agreement (DA 24-00001) to correct scrivener's <br />errors regarding parcel numbers as detailed in the Amended DA, which is attached hereto and <br />hereby incorporated by this reference; and <br />The County has incorporated minor modification provisions in the amended Development <br />Agreement that allows for scrivener errors to be addressed at the administrative level as long as <br />those errors are not outside the scope ofthe approved project; and <br />The County has incorporated major modification provisions in the amended Development <br />Agreement, where proposals that are outside the scope of the approved project are required to <br />amend the DA pursuant to KCC l5^A.1l " Development Agreements"; and <br />The County agrees that all the terms within the originally approved Development Agreement <br />remain consistent and unchanged; and <br />NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas County, <br />Washington, in the best interest of the public, does hereby reconsider and approve to amend the Ranch at Swauk <br />Creek Development Agreement to correct the identified scrivener's errors regarding parcel numbers and statutes and <br />authorize the Chairman to sign the amended development agreement. <br />DATED this 4ft day of February 2025, at Ellensburg, Washington. <br />BOARD OF COI-INTY COMMISSIONERS <br />, WASHINGTON <br />Julie Kjorsvik <br />Vice-Chairman <br />of the Board- Mandy Buchholz <br />cory <br />Commissioner
