KITTITAS COUNTY <br />BOARD OF COUNTY COMMISSIONERS <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: July 2, 2024 <br /> <br />ACTION REQUESTED: Request to approve a Resolution Annexing “Horse Jump <br />Road Annexation” into Kittitas County Fire Protection <br />District No. 7. <br /> <br /> <br />BACKGROUND: On June 10, 2024, the Kittitas County Board of <br />Commissioners Office received a letter from Auditor Bryan <br />Elliott, along with a Certificate of Sufficiency; map of the <br />area to be annexed; a copy of RCW 52.04.011; Kittitas <br />County Fire District No. 7 Resolution 2024-8 – Accepting <br />Annexation Petition & Approving Annexation; and a full <br />legal description of the parcel numbers to be included in the <br />annexation. RCW 52.04.011(3) allows for the county <br />legislative authority to enter its order incorporating the <br />territory into the existing fire protection district. According <br />to the Auditor’s Certificate of Sufficiency, there are <br />sufficient signatures of registered voters as required by <br />RCW 52.04.011(1). There are 21 voters within the area, 14 <br />petitions were submitted within the area, and a total of 14 <br />signatures of qualified electors were verified, exceeding the <br />required amount to meet sufficiency. The Certificate of <br />Sufficiency was issued for 67%, which is at least 60% of <br />the qualified registered voters who signed the petition. <br /> <br />INTERACTION: The Prosecutor’s office has reviewed the materials, as well <br />as the draft Resolution to be considered by the Board of <br />County Commissioners (#10764). According to DPA <br />Doug Mitchell, there is no public hearing needed by the <br />Board of County Commissioner pursuant to the statute. He <br />also noted, "the county legislative authority or authorities <br />of the county or counties within which such territory is <br />located have the authority and duty to determine on an <br />equitable basis, the amount of any obligation which the <br />territory to be annexed to the district shall assume to place <br />the property owners of the existing district on a fair and <br />equitable relationship with the property owners of the <br />territory to be annexed as a result of the benefits of <br />annexing to a district previously supported by the property <br />owners of the existing district." RCW 52.05.011(2). <br />
