KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />STAFF REPORT FOR PUBLIC HEARING <br /> <br />DATE: April 2, 2024 <br /> <br />ACTION REQUESTED: Discuss an Ordinance Amending Chapter 18.02 KCC, <br />governing Kittitas County’s Code Enforcement procedures, <br />to correct minor internal inconsistencies. <br /> <br />BACKGROUND: New Code Enforcement Officer Laura Kukes and DPA <br />Eldred have been working together to maximize the <br />efficiency and efficacy of the code enforcement process. In <br />doing so, a few minor inconsistencies in the code were <br />noticed, one with significant consequences. As currently <br />written, KCC 18.02.030(6)(f) calls into question whether <br />Kittitas County intends for the Hearing Examiner’s order <br />on a NOVA appeal to be a final land use decision, which it <br />absolutely should be under State law (chapter RCW 36.70c, <br />the Land Use Petition Act). <br /> <br />INTERACTION: Staff members from the PAO are working with outgoing <br />CDS Director Mark Cook to ensure a legacy of excellence <br />in the code enforcement arena in Kittitas County. <br /> <br />RECOMMENDATION: Set a public hearing to discuss adoption of the proposed <br />ordinance, attached. <br /> <br /> <br />ATTACHMENT: Draft Ordinance with proposed amendments to the <br />code, attached. <br /> <br />LEAD STAFF: Jesse J.
