KITTITAS COUNTY
Board of County Commissioners

STAFF REPORT FOR PUBLIC HEARING

DATE: April 2, 2024

ACTION REQUESTED: Discuss an Ordinance Amending Chapter 18.02 KCC,
governing Kittitas County’s Code Enforcement procedures,
to correct minor internal inconsistencies.

BACKGROUND: New Code Enforcement Officer Laura Kukes and DPA
Eldred have been working together to maximize the
efficiency and efficacy of the code enforcement process. In
doing so, a few minor inconsistencies in the code were
noticed, one with significant consequences. As currently
written, KCC 18.02.030(6)(f) calls into question whether
Kittitas County intends for the Hearing Examiner’s order
on a NOVA appeal to be a final land use decision, which it
absolutely should be under State law (chapter RCW 36.70c,
the Land Use Petition Act).

INTERACTION: Staff members from the PAO are working with outgoing
CDS Director Mark Cook to ensure a legacy of excellence
in the code enforcement arena in Kittitas County.

RECOMMENDATION: Set a public hearing to discuss adoption of the proposed
ordinance, attached.

ATTACHMENT: Draft Ordinance with proposed amendments to the
code, attached.

LEAD STAFF: Jesse J. Eldred, DPA.
