i <br />V .He44 i n nTu <br />Public Health <br />To Protect and Promote the Health and the Environment of the People of Kittitas County <br />BOCC Staff Report <br />AGENDA SESSION DATE: <br />April 2, 2024 <br />ACTION REQUESTED: <br />That the Board of County Commissioners consider the Odd Fellows Lodge 20 Housing Project request of <br />$338,000 to be funded through Affordable and Supportive Housing Sales Tax revenue and Affordable <br />Housing Surcharge Fee revenue (fund 112). <br />ATTACHMENTS: <br />Odd Fellows Lodge 20 Housing Project application packet <br />BACKGROUND: <br />The funding application was presented at the Homelessness and Affordable Housing Committee (HAHC) <br />regular meeting on December 4, 2023. Per approved meeting minutes, the committee members <br />approved the funding after discussion. <br />The previously established scoring matrix was not used in application review and thus not included as an <br />attachment. Public Health staff is not able to speak to the decision -making process or details of the <br />recommendation. <br />Public Health staff consulted with DPA Stephanie Hartung for a legal recommendation to the BOCC <br />below. <br />INTERACTION: <br />Prosecutor Review LRS #10509 <br />PROSECUTOR'S OFFICE LEGAL RECOMMENDATION: <br />That the Board of County Commissioners remand the funding application back to staff. Staff should <br />support HAHC to process the application (and any future applications) through an updated request for <br />proposal review and scoring process with appropriate documentation. That process should be vetted by <br />legal to ensure statutory compliance prior to implementation. Currently, there is not enough <br />information for the BOCC to make an informed decision as to this application and approval at this time <br />would not meet the required fiduciary duty owed to the taxpayers. <br />LEAD STAFF: <br />Chelsey Loeffers, Director <br />
